Bengaluru: Chief Commissioner Tushar Girinath has instructed the officials to strictly follow the orders and directions issued by the Supreme Court regulating the sale and use of firecrackers within the jurisdiction of BBMP.

   The Supreme Court has given many directions regarding fireworks. As per the order of the State Pollution Control Board, only GREEN FIRECRACKERS are allowed to be burst from 8 pm to 10 pm. During the rest of the time bursting of firecrackers is completely banned.

 The sale and use of any other firecrackers except GREEN FIRECRACKERS as permitted by the Supreme Court directives is also prohibited. Information about 'green firecrackers' will be available on the website of the Karnataka State Pollution Board (https://kspcb.karnataka.gov.in/honble-supreme-court-directions-fire-crrackers)

 Public should celebrate Deepavali 2024 in an eco-friendly way. Officials should strictly instruct them to use only green crackers. Action should be taken against those selling and stocking banned firecrackers and confiscation of the entire warehouse. Tushar Girinath suggested that steps should be taken to register a criminal case against the concerned persons.

 Bengaluru: BBMP Chief Commissioner Tushar Girinath has issued an order giving responsibility to the zonal commissioners to clear the buildings and unauthorized constructions that are being constructed in violation of the plan in the city.

 The Chief Commissioner, who has issued devolution order regarding violation of sanctioned plans, prohibition of construction of unauthorized buildings, has directed to prevent all kinds of violations.

 City sanctioned building plans are published online. Within 30 days of approval of this plan, the Town Planning Officer shall mark the 'Building Plinth Line' in the presence of the building owners or their representatives. It should be confirmed by Joint Director of Central and Zonal Office.

 Junior, Assistant Engineer, Assistant Executive Engineer (AEE), Executive Engineer in the ward should get the details of the sanctioned plan and ensure that the construction is progressing accordingly from time to time.

 In case of complaints from the public about the construction of the building, the AEE of the sub-division should send a junior engineer for inspection. A comprehensive report of that building should be submitted to AEE within 24 hours of receiving the complaint. 

 The AEE shall issue notices to inspect the construction violations in the presence of the owner. Site inspection should be done within 15 days. After reviewing the violation report by the Zonal Commissioner, the AEE shall issue a notice to the owner within 15 days to stop construction.  After conducting all kinds of investigations during this period, the Zonal Commissioner should issue an order to vacate the building under construction giving 30 days time.

After issuing a notice to the owner to prevent construction, the responsibility of preventing any construction will be on the Junior/Assistant Engineer of the respective Ward and the AEE. Disciplinary action will be taken if they are negligent.

 The zonal commissioner should issue an order to vacate the buildings in violation of the rules and complete the eviction work within the time limit. For clearance of unauthorized building constructions as per rate lists, floor wise cost per square meter should be prepared and approved by Zonal Commissioner by Executive Engineer. An agency should be hired for building clearance.

 The cost of vacating the building should be met from the sector's revolving fund. Then the Chief Commissioner has issued an order mentioning many sections of the BBMP Act-2020 that action should be taken to recover that cost from the building owner from the revenue department.

 Bengaluru: BBMP has decided to restrict haphazard development activities in the outskirts of the city. Banning sanction of building plan for plots where 'layout plan' has not been approved by BDA.

 As per Section 17 of the Karnataka Urban and Country (KTCP) Act, 1961, the 'planning map' must be approved by the local planning authority for the land converted. BBMP can give account and sanction building plan only for such single plots and barangays.

 In violation of this act, BBMP was directly accounting for areas less than 20 thousand square meters and giving plan approval. To this, the Bengaluru Development Authority (BDA) took issue and wrote a letter on September 4, 2024 stating that this approval was contrary to the KTCP Act, which drew the attention of the BBMP.

 BBMP has thoroughly investigated the matter and taken advice from legal experts. Accordingly, the Chief Commissioner has issued an order on October 3 to approve building construction plan only in six classifications of single location, multiple location or layout.

 If the BDA does not approve the 'layout plan' as per the KTCP Act, there is a possibility of haphazard development in those areas. A Layout plan or design plan like a master plan is approved based on the planned development. This can prevent the encroachment of lakes and canals in this context. Also, like the master plan, the classification of commercial and residential areas including the infrastructure like roads and sewers will also be entered in the 'layout plan'. This will enable construction of the planned area,' BBMP Town planning officials informed.

 BBMP has also restricted the sanction of building plan for single plots or multiple plots in lands under the jurisdiction of Justice Keshav Narayan Samiti in BDA Arkavati layout.

 Initially, 3,329 acres were notified for acquisition of Arkavati layout. In the final revised notification there is only 1,766 acres. The notified lands are subject to scrutiny by the committee. Therefore, there will be no opportunity to give any khatha and allow development for these lands, BDA said.

 BDA has issued notification of land acquisition for Nadaprabhu Kempegowda layout, Dr. Shivramakaranta layout area, peripheral circle road and other areas. These lands are under the purview of development tax under Section-20 of BDA Act 1976. BDA will not approve single plot or multi plot layout plan in such lands. The BDA has informed through a letter that if BBMP gives khatha and building plan for such plots, there will be financial loss. Considering all this, the BBMP Commissioner has issued a restraining order on October 3.

Bengaluru: The Bengaluru Development Authority (BDA) has issued the allotment letter of the civic facility (CA) plot, which was earmarked for a government college two decades ago, on August 14.

 In Sir M. Visvesvaraya (SMV) layout 1st Block, Civil Facility (CA) Plot No. 3 was earmarked for the Government College.  It was reported by on October 3 under the title 'Neglect to provide college land' that BDA did not allocate the land to the education department.

 BDA President N.A.  Harris's signature is pending, he will sign soon," said BDA Commissioner N.  Jayaram said.  After completing all this process, the allotment letter, which was ready on October 8, was handed over to the college education department officials on Monday.

 Market Rate: 

19,109.91 sq.mtr CA plot is charged at ₹9,750 per sq.mtr.  The allotment letter suggested payment of ₹21.98 crore in one installment including GST of ₹3.35 crore.

 The lease is being given for 30 years and ₹ 60.80 lakh including GST is to be paid as lease payment of ₹ 3.98 crore every year.  Besides, it was asked to pay an additional ₹57,000 every year.

 CA Sites should be given to government departments including hospital, education, BESCOM at 20% of the rate of plots allotted in BDA layouts.  Jayaprakash Narayan Forum President Sivakumar complained that the allotment letter has been given to the education department at the current market rate for this CA site which was earmarked two decades ago for a government college in the first block of Visvesvaraya (SMV) Layout.

 Bengaluru: Eight zonal commissioners have not taken disciplinary action against anyone even after a year and a half of detecting cases of illegal 'A Khata' for more than 45,000 properties under BBMP.

   Investigation revealed that 'A' KHATHA was issued using 'R code 130' of 'IFMS' software by illegally collecting development fee from the owners of properties eligible for B KHATHA. From 2015 to 2023, a total of ₹898.70 crore has been paid in 45,133 cases. In July 2023, the then Special Commissioner of Finance Jayaram Raipur gave an investigation report saying that most of these cases are illegal.

 As per government order, 'R Code- 130' is used to issue A khata against development charges for properties in certain areas including slums. AROs who have misused this code have issued A KHATHA for assets that should have B KHATHA. Development charges are not payable for unconverted plots. All such assets are recorded in B Khata or Wahi. In such cases also illegality has been committed by issuing A khata. It was suggested last year that the Zonal Commissioner should take action against all such officers and submit a report.

 If the owner of the plot who has paid the development fee illegally to get A khata files a confession application, the fee will be refunded. Otherwise the amount will remain with the BBMP. It was also said that the illegal A KHATHA will be canceled and all those assets will be transferred to B KHATHA. 

 Jayaram was transferred after instructing the Zonal Commissioner to take action. Later, BBMP Chief Commissioner Tushar Girinath ordered to form a committee under the leadership of Munish Moudgil, Special Commissioner of Revenue Department, to take action on these cases. However, no action has been taken so far.

 An investigation has already been conducted into the 'illegal 'A' accounts and Jayaram, the former special commissioner in the finance department, has given a report about who is guilty. Zonal Commissioner should take action accordingly. Although a new committee has been formed to investigate, there is no new action to be taken. Therefore the zonal commissioner should take disciplinary action as per the previous order. They will be reminded again about this," said Munish Maudgil, Special Commissioner of Revenue Department, to Prajavani.

Bengaluru: The state government has decided to upgrade government schools and colleges to the level of private institutions. However, the Bangalore Development Authority (BDA) has been neglecting for decades to allot the land earmarked for the government college.

 Built by BDA two decades ago,  Civil Facility (CA) plot No. 3 in the first block of Sir M.Visvesvaraya (SMV) Layout has been earmarked for Government College. However, the BDA site has not been allotted to the Education Department so far.

 The Director of College Education has written to the BDA saying that the CA site reserved for Kengeri First Class College should be allotted. In connection with the same issue, MLA of Yeshavantpur Assembly Constituency S.T. Somashekhar has also written four times to the BDA Commissioner and President. The BDA estate officials asked in July 'in whose name the land should be allotted and a 30-year lease agreement should be signed'. In response, the Director of College Education has requested that it be allocated to 'Kengeri First Class College'. There has been no process since July.

 Kengeri First grade College has five courses including BA, BCom, BBA, BSc BBM and 1,100 students are studying. Now the college is running in the building of Kengeri High School.  that there are not many facilities in this college, which has more students than private colleges. A.V., Lakshminarayan, Principal of Kengeri Government First Class College, said.

 At least 30 rooms are required for the existing students in the school. However, classes are held in 13 rooms and on the top of the building. He informed that there is no laboratory, library and rooms for lecturers in the science department.

Letters have been written for over a year to allot the CA site reserved for the government college to the education department. A request has been made to the BDA officials personally. More than one thousand students need a well equipped building and modern facilities. If this land is found, a model college will be built,' he said.

 If the CA site is to be allotted to the government departments, the chairman and commissioner of the authority should approve it. I have approved the process of allotment of land to Kengeri College. Pending the approval of the President, he may give his approval in a few days," said BDA Commissioner N. Jayaram told Prajavani.

 'Legislator, DCM instruction not recognized'

 Local MLA S.T.Somashekhar wants to allocate land to Kengeri grade Class College and wrote a letter to BDA president and commissioner. Deputy Chief Minister D.K. Shivakumar has suggested to take quick action in this regard. But, the BDA officials are not moving forward,'' complained Sivakumar, president of Jayaprakash Narayan Forum.

 The BDA officials, who have succumbed to private pressure, are delaying giving the plot reserved for the government college. If the land is not allotted to the college soon, there will be a struggle,' he said.
