Bangalore: Dr. The Bengaluru Development Authority, which has fixed the rates of plots in Shivaram Karanta Barangay, is awaiting the government's approval for its implementation.

 A proposal has been submitted to the government to fix ₹4,900 per square foot for all plots measuring 30x40 feet and beyond in Shivaram Karanta Barangay. It is proposed to fix a rate of ₹3,850 for 20x30 feet plots to benefit the economically backward.

 There are 34,000 plots in the settlement, out of which almost half of the plots are to be reserved for farmers. Thus, the BDA has decided to fix the rates for Shivaram Karant Barangay plots higher than the previous barangays in order to cover the cost of development and sought the government's approval. The rate is lower than the market rate around the barangay," said senior BDA officials.

 Plots were being allotted in Nadaprabhu Kempegowda Barangay since 2016 and were fixed at ₹2,200 to ₹2,400 per square foot. BDA has decided to capitalize on the demand for Shivram Karanta Barangay near Kempegowda International Airport and the proposed Peripheral Ring Road (PRR).

 Under the leadership of the Supreme Court Committee, Shivaram Karanta Barangay is being developed and has expanded in 17 villages. So far about 30 thousand plots have been developed and about 25 thousand plots have been numbered. The Supreme Court committee members and Deputy Chief Minister said that the process of allotment of plots will start in September itself. However, so far that process has not been started.

 Rate of flats increased by 3% to 8%

 The flat rates of the seven projects built by BDA and available for sale will increase by 3% to 8% in the near future.



 Deputy Chief Minister D.K. In the meeting held with Shivakumar, there was a discussion about increasing the notified rate of flats in the wake of the increase in the guideline rate. DCM also suggested to take a clear decision in this regard.

 BDA housing department engineers have prepared a proposal to increase the rates of flats, which will be submitted to the board meeting of the authority after obtaining the approval of the BDA commissioner. There the notified rate will come into force after approval.

 The rate of flats will be re-fixed as per the guideline rate and the rate of flats in Nagarabhavi will increase by 8%. In the blink of an eye, the price of flats will increase by at least 3%. BDA officials said that the flat of the remaining projects will increase by 3% to 8%.

 BENGALURU: The government is violating All India Services (AIS) rules by giving IAS officers responsibility for posts that could be handled by other cadres. It also broke the rule that such posts should be given to IAS officers.

 Officers who have risen from lower level positions in the department have technical knowledge and experience. Irrigation, Public Works, Energy Department Secretary, Corporation Managing Director posts were given to Chief Engineers of respective departments. There is also an allegation that an unwritten rule has been created that such posts are reserved for IAS officers.

 Among the administrative posts in the state, 163 posts of senior rank are reserved for IAS officers. AIS Rule R8(2), 11(R1)) clearly mentions the post in which IAS officers should hold. 25% of the IAS officers appointed to these posts i.e. only 40 posts can work in non-scheduled, ex-cadre. However, this number is 129 in the state.

 40% of the IAS officers allotted to Karnataka can go to Central service on deputation. That means, 65 people are allowed to go. However, this number has not crossed 25.

The important posts of heads of various departments, corporations, boards under the purview of the state government have been identified as ex-cadre posts. In these posts, the number of officers of senior rank cannot exceed 40. If, however, the period cannot continue for more than six months. The rule states that if there is an imperative to proceed, the permission of the Central Government is required.

 "IAS officers have continued in cadre posts as well as ex-cadre posts for years. They does not want to go to central government posts, they holds many posts including corporation-board. Some hold two-three ex-cadre posts along with the cadre post. Due to this, non-IAS officers are missing the opportunity to assume higher posts and get promoted. A senior official who did not want to be named informed that since it is the IAS officers who make the administrative rules in the state government, the chief minister and the minister are not aware of the AIS rules and their violations.

 The state government is deputing IAS, IPS, IFS officers through ex-cadre to its subordinate departments, corporation-boards and authorities. He is not needed in all posts. There is no guideline on what basis they are being appointed. If there is this guideline, IAS officers are also covering up the request to publish it', he complained.

ACS post beyond the rules!

 According to AIS rules, there should be two additional chief secretaries. However, there are eight ACSs in the state government. As soon as January comes, all these years of service are over and they get promoted and become ACS. However, it is not guaranteed whether it is allowed or not. Officials said that six ACSs are in that post beyond the rules.

'Occupying is not right in all positions'

 IAS, IPS and IFS officers have their own posts. No one else can go to those positions. Likewise, it is not right for them to occupy unnecessary posts. It is illegal to appoint IAS officers to the environment sector department, corporation and authorities. This is clearly stated in the order of the suit filed by me in the High Court regarding the appointment of the Chairman and Member Secretary of the State Pollution Control Board. Government should properly utilize the potential of IAS officers. Anjaneya Reddy said that all posts should be stopped from IAS, IPS and IFS.

Bengaluru: The BBMP is in a crisis due to the condition of the approval given to the action plan drawn up under the Finance Commission grant for the development of lakes.

 The government has stipulated that the development works of the lakes should be taken up only after identifying the boundaries of the lakes and clearing the encroachment in them. In the 15th Finance Commission grant for the year 2022-23, ₹49 crore has been given for the development of 14 lakes.

 Earlier, a detailed project report (DPR) was prepared, tenders were called and work orders were issued as soon as development of lakes was approved. The encroachment was noticed only after the work started. Apart from that, there are examples of works being carried out in many lakes.

 This time, the lack of permission for such a task has put the BBMP officials in 'difficulty'. It is regrettable on the part of BBMP engineers that the work should start only after the area of the lake, demarcation and clearance of encroachments. However, this condition has made the city dwellers and environmental activists happy, and there is hope that the lakes will remain intact.

Is it possible to clear the encroachment of Madiwala Lake?: 

The Forest Department has been earmarked ₹15 crore for the development of Madiwala Lake, which has recently been handed over to BBMP. The government encroachment is only 10 acres in Madiwala Lake, which is 267 acres in area. BDA Road, other roads, slums, buildings have been constructed. This encroachment has not been cleared for many decades. This is a challenge for BBMP officials.

 Madiwala lake has not been desilted for decades. Its work is very high. In addition, the pressure is too high. To remove this first, rehabilitation, BDA roads are all obstacles. These can be difficult to clear. However, efforts will be made to clear the encroachment. Madiwala lake is very big and requires huge amount of money for its development. First DPR is prepared. After that, the whole process will start," said the engineers of the BBMP Lake Division.

 Slums have been built in Kacharkanahalli Lake. No lake survey has been done here. Local politicians assured that, will clear the encroachments. However, half of the lake is encroached. According to the CONDITION, the work should be started only after the rehabilitation of all of them. It will take a lot of years, say the engineers.

 The survey of Halasuru and Veerasagara lakes has not been done till now. Survey of these should be done first. Only then should the process of development work begin. Also, many of the 14 lakes have already developed to some extent. The question is how this CONDITION applies there. Thus, it is also true that the government CONDITION has given more responsibility to the officials of BBMP. Environmental activists are of the opinion that if this is implemented in full, it will benefit the environment.

 Not included in the 'action plan'!

 Madiwala, Kacharakanahalli, Halasuru, Anjanapura lakes have not been included in the 'action plan' submitted by the High Court regarding clearing encroachment of lakes. Only 149 lakes are in the action plan and the rest of the lakes are not in the list even though they are encroached.

 It is not necessary to clear only encroachments in the lakes in the 'Action Plan'. Action will be taken to clear encroachment in all the lakes. Engineers of BBMP Lakes Department said that development works will be carried out by giving first priority to squatters.

 Survey as a map?

 It is a good thing that the government has stipulated that the lakes should be surveyed, encroachment should be cleared and then development should be done. But, the question is on the basis of which map the survey will be conducted. First needed answer for this, take a clear stand and move forward,' demanded Ramprasad of Friends of Lake.

 The survey should be conducted like the revenue map of 1974 to 1976. In 2015, there are new surveys done by the land surveyors of the revenue department. There is a lot of variation in these. Thus, if the survey and development are carried out as per the old revenue map, the water storage of the lakes will increase. Along with the increase in ground water, the environment will also be protected,' he said.

 Bengaluru: The government has approved the action plans of the 15th Finance Commission for the year 2022-23 with a grant of ₹291 crore released by the previous BJP government.

 Funds were released on May 25, 2023 for water supply, sanitation, lake rejuvenation and solid waste management in BBMP. Accordingly, in the meeting held under the chairmanship of the Chief Commissioner of BBMP on September 6, an action plan was formulated for the required works.

 A proposal for an action plan was submitted to the government. On December 11, the government gave conditional approval to the list of 'micro level action plan' works.

 Technical approval should be obtained for the approved action plan works, packaged not less than ₹10 crore and tender called through e-procurement as per KTPP Act.

 It has been stipulated that an online software should be prepared and monthly progress uploaded for checking and monitoring the progress of implementation of the 'micro-level action plan' works.

 Development after Clearance of Encroachments: It has been clearly mentioned in the order sanctioning the action plan that the encroachments should be cleared before starting the revival and development works of the lakes.

 The village map of the lakes, like the survey map should mark the boundaries properly. It has been stipulated that the works should be started after clearing any encroachments.

 Bengaluru: There are many hurdles to restart the Eijipura Elevated Corridor project which was formed nine years ago.

 The work of completing the flyover started on Friday. However, many obstacles such as IISC technical report, delay in land acquisition process, obstruction in clearing of trees have started from day one.

 The work has been stopped for two years, how should it be reconsteucted? The Indian Institute of Science (IISC) has to issue a technical report on what precaution or technology should be adopted. The basic work will start only after this report is received. It will be two months before this report is available.

 The process of land acquisition of private buildings including Central House, St. John's Hospital, Bwssb buildings has not yet been completed. The required land is marked on the buildings and compounds. However, the process of acquiring it has to start again.

 Talks have been held with the owners in the past regarding land acquisition. Everyone wanted cash. Now we have to negotiate again and finalize everything. Survey work is also to be done. Everything has been prepared for this," said Yogesh, Executive Engineer of BBMP Planning Department.

A survey will be conducted, a high-level meeting will be held with government agencies and the solution will be decided. Talks are also held with private individuals. It will take two-three months to complete all this,' he said.

 It is not possible to build an overpass without clearing the trees. The final decision was taken after holding a meeting in this regard. Discuss with the forest department and proceed on the advice of the law cell,” he said.

 It will take another three to four months to start all the work on the flyover. We have started preliminary work in the plant and ramp work in Dommalur side. Here too, work will be done only if the trees are cleared," said Suresh, the contractor's project manager.

 "Seven or eight years of chaos is enough. Locals are saying that if this flyover is completed soon, it will be enough. The target is to complete the construction of the flyover in 15 months. However, due to many disruptions, this period is likely to increase further.

 Opposition to clearing of trees

 The committee has given approval to cut 67 trees to complete the construction of Ejipura flyover, which has been entrusted to the contractor. As some environmental activists objected to this, the work of clearing the trees, which had started on Friday, was stopped," said DCF Swamy of BBMP Forest Department.

 "Without cutting down all the trees, some trees can be saved. Our demand is to cut down the twigs and branches that are obstructing the work and save the 50-60 year old trees. Also, BBMP has been requested to change the plan map in order to save the trees," said Vinod Jacob, General Manager of Namma Bengaluru Foundation.

2014 scheme

 Elevated Corridor (Ejipura Flyover) on Koramangala Outer Ring Road 2.5 km. It is a long flyover. This project was formulated in 2014. In 2017, the contract was awarded to Simplex Infrastructure for ₹157.66 crore. The project was to be completed by 2019. However, the contractor delayed. Even after four years and seven months, only 42% of the work was completed. ₹75.11 crore was also paid to him.

 Adinarayan Shetty filed a writ in the High Court due to the delay in the work of the flyover. The High Court, which had given its verdict on February 17, 2022, had canceled the tender and invited a fresh tender and directed to complete the work at the earliest. But due to BBMP's delay, the tender invited for the fourth time was accepted in March 2023. After negotiations with the contractor, it was submitted for cabinet approval in August. Although approved on September 7, a turnkey lumpsum contract with BSCPL Infrastructure for ₹176.11 crore was awarded on November 17.

Bengaluru: BDA has cleared the commercial building being constructed on the land acquired by BDA in Banasawadi and has taken over.

BDA Engineering Department and BDA SP Nanjundegowda's staff conducted operations on Monday morning as per BDA Commissioner N. Jayaram's orders. A commercial building under construction was cleared and the materials were seized. A board has been installed in the place saying 'BDA asset'.

 Bengaluru: BDA, BBMP, revenue department officials have created 'fake documents' and helped sell the land worth crores acquired by Bengaluru Development Authority to private individuals.

 BDA Land Acquisition Officer has given clear information that 'the land has not been denotified by acquisition process'. But till date BDA has not taken possession of the land. Although a commercial building is being constructed there since a few months ago, the authorities are silent without taking any action due to the fear of the 'retired IAS officer'.


 In 1980, BDA has acquired the entire land of survey no. 260 and 261. In 1984, compensation was given to the land owners. In 1986, a court case was filed and additional compensation was sought from the land owner, B.C. Rajurathnamma got it. On top of this, they built a sheet house in an area of 7,000 square feet and submitted a request to the High Court to regularize the houses.

 The High Court rejected the plea in 1995 saying that the house could not be regularized as the compensation was received twice. Meanwhile, in 1992, 6.5 acres of land was sold to Venkatamma without registering the survey number. Deed of sale in the office of the Sub-Registrar K.R. Pura (6319-93-94).

In 2014, the Executive Engineer of BDA North Division issued letter to Assistant Revenue Officer (ARO) of BBMP East Zone stating that BDA has not taken possession of the 6.5 acre plot in survey no. 261. ARO has issued Khata Certificate to No. 1085/2 in Banasawadi 88th Ward. Based on this, the Bangalore North Sub-Divisional Officer. On these documents, Assistant Commissioner stated that 'Revenue Officer, Sarvajna Nagar has issued a letter without number, to check it and take action'. Despite such a notice, the revenue officials have mentioned that 6.5 guntas of land in Pahani belongs to Venkatamma.

 The revenue officials have changed the RTC considering the Khata given by BBMP ARO. BBMP ARO issued Khata on letter issued by BDA EE. However, these officials have illegally issued letters and postscripts which are not within their jurisdiction. social activist M. Muniraju complained.

 Retired IAS officer HAND!

 A retired IAS officer who was the commissioner of BBMP and was the additional chief secretary put pressure on BDA, BBMP and revenue department officials and grabbed the land in the name of benami. Muniraju complained that the BDA officials did not take action because of the threat of the officer who started the work on the commercial building.

 BDA officials have not taken any action even though the vouchers, pahanis and accounts are illegal. A commercial building is being constructed there for four months now. A request has been submitted to the Commissioner and the Chairman in this regard. Land should be taken over by BDA. Action has also been taken against the officials who have committed illegal acts said Muniraju.

No action by Deputy Secretary!

 Banasawadi village survey no. 261 has 1 acre 32 gunta land and is the primary and final notification for construction of HRBR barangay. (HUD/49/MNJ/78– dated 14.05.1980). B.C. Rajurathnamma is the notified account holder. The acquisition of this land was handed over to the Technical Department of the Authority on 24th May, 1984. The land is owned by the authority. As per the documents on file with LAC, no area is left to anyone in this survey number. Additional Land Acquisition Officer of BDA has written a note dated 18th July 2023 that no Denotify letter given by the Additional Land Acquisition Officer. Then Deputy Secretary-4 should have taken action for possession. No process has been done for four months.

 Immediately action taken: Commissioner Jayaram

 Banasavadi Survey no. In 261, the private encroachment on the land acquired by BDA will be checked and will take back land immediately. BDA Commissioner N. Jayaram said.

 Bengaluru: Even though BBMP has been filing for 14 weeks to clear encroachment of lakes, not a single order has been issued by Tehsildars for the clearance operation.

 As per the action plan submitted to the High Court, the BBMP is submitting the information about the lakes to the Tehsildar from September 5. Every week the information of 10 lakes is being submitted by the Executive Engineers of the Lakes Division to the respective Tehsildars.

 As per the action plan, the encroachment clearing process of 159 lakes should start in 16 weeks. BBMP officials have to submit encroachment information of 159 lakes in 16 weeks to tehsildars like 10 lakes every week. As such, a list of 140 lakes for 14 weeks has been submitted so far.

 It has been 90 days since the first week of encroachment information was submitted. It has been 70 days since the submission of information for the second week and the third week. At least 30 lakes should have been completely cleared of encroachment after all the process was completed. However, the Tahsildars have not started the process of ordering the eviction of encroachments.

 As per the action plan submitted to the High Court, information on 10 lakes has been provided by BBMP every week. The 16-week process will be completed in two weeks. However, till now we have not received any order from the tehsildars to clear the encroachment of the lakes,' said officials of the BBMP lake department.

BBMP Chief Commissioner Tushar Girinath held a meeting with District Commissioner Dayanand and Tehsildars and warned that the order processes for clearing the encroachment of lake and Raj canal should be completed within the period. Officials said that even after this, there was no process of inquiry or order for eviction operation by the tehsildars.

 It is said that a survey of some lakes in Yalahanka and Dasarahalli zone has been conducted. However, no official order or information has come to the BBMP from the Tahsildar offices.

 They say that the lack of staff for the survey is a sign of stress. There is shortage of staff in all departments. There are only 15 personnel in the BBMP Lakes Division, which is responsible for around 200 lakes. Aren't we doing all the work too? Don't we have pressure? If the action plan does not work, the High Court will take us to task. Are we not under pressure,' asked the engineers.

 Protection for land grabbers: Although the High Court has instructed to clear the encroachment of lakes under BBMP, there is delay at the level of Tehsildars. following a slow pace in order to allow land grabbers, Environmental activist T.E. Srinivas complained.

 The process is not going on as per the action plan as ordered by the High Court. Dayanand did not answer the question why there is no eviction order even after three months.

 All lakes need a nodal officer.

 Citizens have raised objections about not appointing nodal officers for lakes that require maintenance and supervision under the jurisdiction of BBMP. They have complained that officials have not been appointed for some lakes to accommodate the encroachment.

 There is a list of encroachments in 159 lakes in the city in the action plan submitted by BBMP to the High Court. However, nodal officers have not been appointed for all these lakes,' complained Goudaiah, an environmental activist.

 Nodal officers have not been appointed for 19 lakes including Hoskerehalli lake, Karihobanahalli, Kannalli, Chikkabellandur, Dodda Bidarakallu, Narsappanahalli, Nelegedaranahalli, Lakshmipur, where the road was built between the lakes. He demanded that officers should be appointed to oversee all the lakes under the jurisdiction of BBMP.

 Nodal officers have been appointed for 140 lakes on the advice of local executive engineers for developed and required lakes. It is not final, there is room for revision. Efforts will be made to appoint nodal officers for all the lakes, said officials of the lakes department.
