No Khata for unapproved property

Bengaluru: An order has been issued not to issue any kind of Khata for properties under BBMP jurisdiction if they are not approved by the competent planning authority.

Section 17 of the Karnataka Town and Country Planning (KTCP) Act, 1961 has been amended, making it mandatory to obtain approval from the planning authority for all properties, including single plots. BBMP will not be allowed to register or register any A-Khata for such unapproved properties, Chief Commissioner Tushar Girinath has issued an order.

Under Section 95 of the Karnataka Land Revenue Act, 1964 (KLR), ‘single plot’ within the BBMP area, where agricultural land was converted for non-agricultural purposes, was approved and a khata was issued. Now that the KTCP Act has been amended, BBMP will not issue a khata for properties that are not approved by the BDA or the Planning Authority. Also, even if a khata has already been obtained, it is not allowed to divide or sub-divide the khata.

Pending applications for khata cannot be disposed of at BBMP offices. All applications will be cancelled with immediate effect. Disciplinary action will be taken against the officers and employees who violate it, Tushar Girinath said in his circular dated January 7.

* BBMP will not divide or sub-divide the sites that have A or B khata, which are not approved by the competent planning authority. 

* Each unit in a single-unit or multi-unit building for which an Occupancy Certificate (OC) has been obtained with the approval of the competent planning authority will be recorded in A-book and A-Khata will be given.

* Single or multi-units constructed in properties having A or B-book without the approval of the competent planning authority, if they are connected by BESCOM or BWSSB by September 30, 2024, will be given B-book.

* If agricultural land is converted from agricultural to non-agricultural purposes, BBMP will not record a new ‘A’ or ‘B’ book/khata for that vacant land.

‘7 lakh property owners have not paid tax’

‘About seven lakh properties in BBMP area are not paying tax,’ said BBMP Chief Commissioner Tushar Girinath.

‘The information on BESCOM and bwssb connections is not matching with our tax payment data. Also, the owners of two lakh properties with accounts are not paying taxes. All these will be investigated and action will be taken,' he told reporters.

Only commercial buildings that have not paid much property tax are being sealed. He said that they will be given time and action will be taken for auction as per the law.
