Punishment for Feeding Pigeons



Bengaluru: Due to the spread of diseases from pigeons, the BBMP (GBA) has banned feeding them in public places. Pigeons should only be fed at locations identified by the BBMP and during specified times. The Urban Development Department has issued an order stating that legal action should be taken and fines imposed on violators by registering cases under sections 270, 271, and 272 of the Bharatiya Nyaya Sanhita (BNS).

According to this, those who violate the rules and feed pigeons will be booked for negligence causing the spread of infectious diseases. They may face a fine and imprisonment for up to six months.

Key Regulations

 * No person shall feed or encourage the feeding of pigeons in areas that cause public nuisance or health risks.

 * Feeding is allowed only in designated areas subject to specific conditions.

 * Certain NGOs must take responsibility for the maintenance of these designated areas and ensure compliance with the directives.

Health Risks Cited

The Health Department stated that unregulated feeding in public places causes birds to gather in large numbers, leading to excessive droppings and serious health issues. Droppings and feathers from pigeons are increasing the risk of respiratory illnesses such as Hypersensitivity Pneumonitis and other lung diseases.

Expert medical opinions and reports suggest that contact with pigeon droppings and feathers can cause severe and sometimes irreversible lung damage. This risk is particularly high for vulnerable groups such as children, the elderly, and those with pre-existing respiratory problems.

Awareness Measures

In light of the health impacts caused by pigeon droppings and feathers, city corporations have been instructed to conduct awareness programs for the general public regarding this issue.

Sub:- Regulation and Prohibition of Feeding Pigeons in Public Places in the Interest of Public Health

1. It has been brought to the notice of the Health Dept that uncontrolled feeding of pigeons in public places is resulting in large congregations of birds, excessive droppings and serious health concerns. particularly respiratory illnesses linked to prolonged exposure to pigeon droppings and feathers such as hypersensitivity pneumonitis and other lung diseases.

2. The expert medical opinion and reports indicate that such exposure may lead to severe and sometimes irreversible lung damage, especially among vulnerable groups including children, the elderly

and persons with pre-existing respiratory conditions.

3. The Hon'ble High court of Bombay has issued directions to the Greater Mumbai corporation in WP No (905) WP No (L) 2119 of 2025 in similar matter and consequently, the Greater Mumbai Corporation has prescribed regulatory measures to prevent nuisance, safeguard public health, seal pigeon-feeding enclosures (kabutarkhanas).

4. The following provisions of law are available to control the said nuisance:

a. Following sections of the Bharathiya Nyaya Samihitha 2023:

i. 270. Public nuisance.-A person is guilty of a public

nuisance who does any act or is guilty of an illegal

omission which causes anyy common injury. danger or annoyance to the public or to the people in general who dwell or occupy property in the vicinity, or which must necessarily cause injury. obstruction, danger or annoyance to persons who may have occasion to use any public right but a common nuisance is not excused on the ground that it causes some convenience or advantage.

ii. 271. Negligent act likely to spread infection of disease dangerous to life.-Whoever unlawfully or negligently does any act which is, and which he knows or has reason to believe to be, likely to spread the infection of anydisease dangerous to life, shall be punished with imprisonment of either description for a term which may

extend to six months, or with fine, or with both.

iii. 272. Malignant act likely to spread infection of disease dangerous to life.-Whoever malignantly does any act

which is, and which he knows or has reason to believe to be, likely to spread the infection of 81 any disease dangerous to life, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both."

a. The following sections are also available to GBA and Corporations:

i. Section 251 of the Greater Bengaluru Authority Act, 2025: the Greater Bengaluru Authority shall ensure proper sanitation, prevent the spread of dangerous disease and undertake such measures necessary to maintain the standards to public health.

ii. Section 401 of the Karnataka Municipal Corporations Act 1976: the state Government has power to declare any epidemic, endemic, or infectious disease as dangerous disease.

iii. Section 58 (17) &section 59 (4) (5) (23): it is obligatory on the part of the municipal corporation to take suitable measure to mitigate the causes of dangerous disease.

4. In this background, the Urban development department is

requested to issue suitable directions in exercise of the powers conferred by section 19 read with section 111 of the Greater Bengaluru Authority Act, 2025 and section 360 of the Karnataka Municipal corporations Act, 1976 to the commissioner, the Greater Bengaluru Authority and the Commissioners and chief officers of other municipal corporations. These directions could be as follows: -

5. The commissioner, the Greater Bengaluru Authority and the Commissioners and chief oficers of other municipal corporations shall take necessary action to mitigate the causes of dangerous

disease spread by pigeon and enforce following guidelines in their respective jurisdiction, namely:

a. No person shall feed pigeons or cause pigeons to be fed in any of the areas which may cause nuisance or health hazard to the public.

b. The pigeon feeding shall be permitted only in designated areas in a controlled manner, with following conditions:

i. The designated areas may be selected in consultationwith stakeholders.

ii. The responsibility for upkeep of the designated areas and compliance to the directions shall be taken up by some charitable organization or an NG0.

ii. The feeding in designated areas shall be permitted only for some limited hours in the day.

c. Authorized Officers of the Local authorities shall issue on-the-spot warnings and may impose fines for violation of this order, or lodge complaint to prosecute under section 271 and

272 of Bharathiya Nyaya Samihitha 2023.

d. The local authority shall conduct public awareness campaigns, including display of signboards, banners and digital messages, explaining:

i. The health hazards associated with pigeon droppings and

feathers.

ii. The content of regulatory directions and the penalties for violations.

iii. Alternative humane methods of bird conservation that do

not endanger public health.

Therefore, the Urban Development Department is requested to issue the above directions to The Greater Bengaluru Authority and all Municipal Corporations to take immediate steps to implement this. (Approved by the Hon'ble HFW Minister)

ಬೆಂಗಳೂರು: ಪಾರಿವಾಳಗಳಿಂದ ಕಾಯಿಲೆಗಳು ಹರಡುತ್ತಿರುವುದರಿಂದ ಸಾರ್ವಜನಿಕ
ಸ್ಥಳಗಳಲ್ಲಿ ಅವುಗಳಿಗೆ ಆಹಾರ ನೀಡುವುದನ್ನು ಜಿಬಿಎ ನಿಷೇಧಿಸಿದೆ.
ಜಿಬಿಎ ಗುರುತಿಸಿರುವ ಸ್ಥಳದಲ್ಲಿ ಮಾತ್ರ ನಿಗದಿತ ಸಮಯದಲ್ಲಿ ಪಾರಿವಾಳಗಳಿಗೆ ಆಹಾರ ನೀಡಬೇಕು. ಇದನ್ನು ಉಲ್ಲಂಘಿಸವರ ಮೇಲೆ ಭಾರತೀಯ ನ್ಯಾಯ ಸಂಹಿತೆ (ಬಿಎನ್ ಎಸ್) 270,  271 ಮತ್ತು 271 ರಂತೆ ಪ್ರಕರಣ ದಾಖಲಿಸಿ, ದಂಡ ಹಾಕುವ ಜೊತೆಗೆ ಕಾನೂನು ಕ್ರಮ ಕೈಗೊಳ್ಳಬೇಕು ಎಂದು ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆ ಸೂಚಿಸಿ, ಆದೇಶ ಹೊರಡಿಸಿದೆ.
ಇದರಂತೆ, ನಿಯಮ ಉಲ್ಲಂಘಿಸಿ ಪಾರಿವಾಳಗಳಿಗೆ ಆಹಾರ ನೀಡಿದವರಿಗೆ, ಸಾಂಕ್ರಾಮಿಕ ರೋಗ ಹರಡಿದ ನಿರ್ಲಕ್ಷ್ಯದ ಪ್ರಕರಣ ದಾಖಲಿಸಲಾಗುತ್ತದೆ. ಅವರಿಗೆ ದಂಡ ಹಾಗೂ ಆರು ತಿಂಗಳವರೆಗೆ ಜೈಲು ಶಿಕ್ಷೆ ವಿಧಿಸಬಹುದಾಗಿದೆ.

ಯಾವುದೇ ವ್ಯಕ್ತಿಯು ಸಾರ್ವಜನಿಕರಿಗೆ ತೊಂದರೆ ಅಥವಾ ಆರೋಗ್ಯದ ಅಪಾಯವನ್ನು ಉಂಟುಮಾಡುವ ಪ್ರದೇಶಗಳಲ್ಲಿ ಪಾರಿವಾಳಗಳಿಗೆ ಆಹಾರವನ್ನು ನೀಡಬಾರದು ಅಥವಾ ಆಹಾರವನ್ನು ನೀಡಲು ಪ್ರೇರೇಪಿಸಬಾರದು.
ಪಾರಿವಾಳಗಳಿಗೆ ಆಹಾರವನ್ನು ನೀಡುವುದನ್ನು ಗೊತ್ತುಪಡಿಸಿದ ಪ್ರದೇಶಗಳಲ್ಲಿ ಮಾತ್ರ ಷರತ್ತುಗಳೊಂದಿಗೆ ಅನುಮತಿಸಲಾಗುತ್ತದೆ. ನಿಗದಿಪಡಿಸಿದ ಪ್ರದೇಶಗಳ ನಿರ್ವಹಣೆ ಮತ್ತು ನಿರ್ದೇಶನಗಳ ಅನುಸರಣೆಯ ಜವಾಬ್ದಾರಿಯನ್ನು ಕೆಲವು ಎನ್‌ಜಿಓ ವಹಿಸಿಕೊಳ್ಳಬೇಕು ಎಂದು ತಿಳಿಸಲಾಗಿದೆ.

ಸಾರ್ವಜನಿಕ ಸ್ಥಳಗಳಲ್ಲಿ ಪಾರಿವಾಳಗಳಿಗೆ ಅನಿಯಂತ್ರಿತವಾಗಿ ಆಹಾರ ನೀಡುವುದರಿಂದ ಪಕ್ಷಿಗಳು ದೊಡ್ಡ ಪ್ರಮಾಣದಲ್ಲಿ ಗುಂಪು ಸೇರುತ್ತಿದ್ದು, ಅತಿಯಾದ ಹಿಕ್ಕೆಗಳು ಮತ್ತು ಗಂಭೀರ ಆರೋಗ್ಯ ಸಮಸ್ಯೆಗಳು  ಉಂಟಾಗುತ್ತಿವೆ ಎಂದು ಆರೋಗ್ಯ ಇಲಾಖೆ ಹೇಳಿದೆ. ಪಾರಿವಾಳದ ಹಿಕ್ಕೆಗಳು ಮತ್ತು ಗರಿಗಳಿಂದ ಶ್ವಾಸಕೋಶದ ಕಾಯಿಲೆಗಳಾದ ಅತಿಸಂವೇದನಾ ನ್ಯುಮೋನಿಟಿಸ್ ಮತ್ತು ಇತರ ಶ್ವಾಸಕೋಶದ ಕಾಯಿಲೆಗಳು ಹೆಚ್ಚುತ್ತಿವೆ.

ತಜ್ಞರ ವೈದ್ಯಕೀಯ ಅಭಿಪ್ರಾಯ ಮತ್ತು ವರದಿಗಳು ಸೂಚಿಸುವಂತೆ,ಪಾರಿವಾಳದ ಹಿಕ್ಕೆಗಳು ಮತ್ತು ಗರಿಗಳ ಸಂಪರ್ಕದಿಂದ ತೀವ್ರವಾದ ಮತ್ತು ಕೆಲವೊಮ್ಮೆ ಸರಿಪಡಿಸಲಾಗದ ಶ್ವಾಸಕೋಶದ ಹಾನಿಗೆ ಕಾರಣವಾಗಬಹುದು. ವಿಶೇಷವಾಗಿ ಮಕ್ಕಳು, ವೃದ್ಧರು ಮತ್ತು ಮೊದಲೇ ಅಸ್ತಿತ್ವದಲ್ಲಿರುವ ಉಸಿರಾಟದ ಸಮಸ್ಯೆ ಇರುವವರಂತಹ ದುರ್ಬಲ ಗುಂಪುಗಳಲ್ಲಿ ಈ ಅಪಾಯ ಹೆಚ್ಚಿರುತ್ತದೆ.

ಹೀಗಾಗಿ, ಪಾರಿವಾಳಗಳ ಹಿಕ್ಕೆಗಳು ಮತ್ತು ಗರಿಗಳಿಂದ ಆರೋಗ್ಯದ ಪರಿಣಾಮ ಬೀರುತ್ತಿರುವುದರಿಂದ  
ನಗರ ಪಾಲಿಕೆಗಳು ಸಾರ್ವಜನಿಕರಲ್ಲಿ ಈ ಬಗ್ಗೆ ಅರಿವು ಮೂಡಿಸುವ ಕಾರ್ಯಕ್ರಮಗಳನ್ನು ನಡೆಸಬೇಕು ಎಂದು ಸೂಚಿಸಲಾಗಿದೆ.
