Bengaluru: The Greater Bengaluru Authority (GBA) has decided to take action against ‘defaulting contractors’ who failed to deposit Provident Fund (PF) contributions for 6,000 sanitation workers (Pourakarmikas).
Despite receiving payments from the BBMP, waste management contractors failed to pay PF for 6,000 workers between 2011 and 2017. Consequently, the Employees' Provident Fund Organisation (EPFO) seized the BBMP's account and took control of ₹90 crore.
On September 15, 2025, the Bengaluru Regional Provident Fund Commissioner issued an order to impose penalties under Sections 14-B and 7-Q of the EPF Act and to recover interest for the delay from the defaulting contractors. The order also stated that these contractors should not be awarded any further contracts.
"Despite the BBMP's appeal to the EPFO, the assessment of ₹90.18 crore remained unchanged, and a final order was issued. An appeal has been filed by the five municipal corporations before the Central Government Industrial Tribunal/Labour Court (CGIT). Following the tribunal's verbal instructions, steps are being taken to make the defaulting contractors parties to this case," Deputy Chief Minister D.K. Shivakumar clarified in the Assembly in response to a question by BJP MLA C.N. Ashwath Narayan.
Officials informed that, "Following the EPFO order, Bengaluru Solid Waste Management Limited (BSWML) has listed the defaulting contractors and begun the process of making them parties to the case. A verification is underway to check if these defaulters are involved in the 33 new waste management packages. The finalization of the new packages has been delayed as the legal department has verbally advised that awarding new contracts to defaulting contractors would lead to legal complications."

Officials Protecting Contractors: Balasubramaniam
"The EPFO has ordered action against defaulting contractors who failed to pay the PF of sanitation workers. Furthermore, the Urban Development Department and the GBA Chief Commissioner have also directed that action be taken. Despite this, BSWML officials are not initiating the process and are instead protecting the contractors who owe the highest penalties," alleged S.N. Balasubramaniam, General Secretary of the Bengaluru City Cleanliness and Lorry Owners-Contractors Association.
He added, "Contractors have committed irregularities and looted Corporation funds. Instead of taking legal action, their bills are being released. Officials are misleading Deputy CM D.K. Shivakumar with false information. Defaulting contractors have surrounded the administration, while those working according to rules are being harassed. If criminal action is not taken against the defaulters, we will intensify our protest."

ಬೆಂಗಳೂರು: ಆರು ಸಾವಿರ ಪೌರ ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯ ನಿಧಿ (ಪಿಎಫ್) ಕಂತುಗಳನ್ನು ಪಾವತಿಸದ ‘ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರ’ ಮೇಲೆ ಕ್ರಮ ಕೈಗೊಳ್ಳಲು ಗ್ರೇಟರ್ ಬೆಂಗಳೂರು ಪ್ರಾಧಿಕಾರ (ಜಿಬಿಎ) ನಿರ್ಧರಿಸಿದೆ.
ಬಿಬಿಎಂಪಿ ಪಾವತಿ ಮಾಡಿದ್ದರೂ ತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ಗುತ್ತಿಗೆದಾರರು ಆರು ಸಾವಿರ ಪೌರಕಾರ್ಮಿಕರಿಗೆ 2011ರಿಂದ 2017ರ ಅವಧಿಯಲ್ಲಿ ಪಿಎಫ್ ಪಾವತಿಸಿರಲಿಲ್ಲ. ಬಿಬಿಎಂಪಿ ಖಾತೆಯನ್ನು ಮುಟ್ಟುಗೋಲು ಹಾಕಿಕೊಂಡು, ₹ 90 ಕೋಟಿಯನ್ನು ‘ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯನಿಧಿ ಸಂಘಟನೆ’ (ಇಪಿಎಫ್ಒ) ತನ್ನ ಅಧೀನದಲ್ಲಿರಿಸಿಕೊಂಡಿದೆ.
ಇಪಿಎಫ್ ಕಾಯ್ದೆ ಸೆಕ್ಷನ್ 14 ‘ಬಿ’ ಮತ್ತು 7 ‘ಕ್ಯೂ’ ನಂತೆ ದಂಡ ವಿಧಿಸುವ ಕೈಗೊಂಡು, ವಿಳಂಬಕ್ಕಾದ ಬಡ್ಡಿಯನ್ನೂ ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರಿಂದ ವಸೂಲಿ ಮಾಡುವಂತೆ ಬೆಂಗಳೂರು ಪ್ರಾದೇಶಿಕ ಭವಿಷ್ಯ ನಿಧಿ ಆಯುಕ್ತರು 2025ರ ಸೆಪ್ಟೆಂಬರ್ 15ರಂದು ಆದೇಶ ಹೊರಡಿಸಿದ್ದರು. ಅವರಿಗೆ ಯಾವುದೇ ರೀತಿಯ ಗುತ್ತಿಗೆಯನ್ನು ನೀಡಬಾರದು ಎಂದು ಆ ಆದೇಶದಲ್ಲಿ ತಿಳಿಸಿದ್ದರು.
‘ಈ ಬಗ್ಗೆ ಇಪಿಎಫ್ಒಗೆ ಬಿಬಿಎಂಪಿ ಮೆಲ್ಮನವಿ ಸಲ್ಲಿಸಿದರೂ ₹ 90.18 ಕೋಟಿಗಳ ಮೌಲ್ಯಮಾಪನವನ್ನು ಬದಲಿಸದೆ, ಅಂತಿಮ ಆದೇಶ ಹೊರಡಿಸಲಾಗಿದೆ. ಐದೂ ನಗರ ಪಾಲಿಕೆಗಳಿಂದ, ಕೇಂದ್ರ ಸರ್ಕಾರದ ಕೈಗಾರಿಕಾ ನ್ಯಾಯ ಮಂಡಳಿ/ ಕಾರ್ಮಿಕ ನ್ಯಾಯಾಲಯಕ್ಕೆ (ಸಿಜಿಐಟಿ) ಅಪೀಲು ಸಲ್ಲಿಸಲಾಗಿದೆ. ಈ ಪ್ರಕರಣದಲ್ಲಿ ನ್ಯಾಯ ಮಂಡಳಿಯ ಮೌಖಿಕ ಸೂಚನೆಯಂತ ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರನ್ನೂ ಸಹ ಪಾರ್ಟಿಯನ್ನಾಗಿ ಮಾಡಲು ಕ್ರಮ ಕೈಗೊಳ್ಳಲಾಗಿದೆ’ ಎಂದು ಉಪ ಮುಖ್ಯಮಂತ್ರಿ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್ ಅವರು ವಿಧಾನಸಭೆಯಲ್ಲಿ ಬಿಜೆಪಿ ಶಾಸಕ ಸಿ.ಎನ್. ಅಶ್ವತ್ಥನಾರಾಯಣ ಅವರ ಪ್ರಶ್ನೆಗೆ ಸ್ಪಷವಾಗಿ ಉತ್ತರಿಸಿದ್ದಾರೆ.
‘ಇಪಿಎಫ್ಒ ಆದೇಶದಂತೆ ಡಿಫಾಲ್ಟ್ ಆಗಿರುವ ಗುತ್ತಿಗೆದಾರರನ್ನು ಪಟ್ಟಿ ಮಾಡಿರುವ ಬೆಂಗಳೂರು ಘನತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ನಿಯಮಿತ (ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್), ಅವರನ್ನು ಪಾರ್ಟಿ ಮಾಡುವ ಪ್ರಕ್ರಿಯೆ ಆರಂಭಿಸಿದೆ. ಹೀಗಾಗಿ, ತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆಗೆಯ 33 ಹೊಸ ಪ್ಯಾಕೇಜ್ನಲ್ಲಿ ಈ ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರು ಇರುವ ಬಗ್ಗೆಯೂ ಪರಿಶೀಲನೆ ನಡೆಸಲಾಗುತ್ತಿದೆ. ಒಂದು ವೇಳೆ ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಮತ್ತೆ ಹೊಸ ಗುತ್ತಿಗೆಯನ್ನು ನೀಡಿದರೆ ಕಾನೂನು ತೊಡಕಾಗುತ್ತದೆ ಎಂದು ಕಾನೂನು ವಿಭಾಗ ಮೌಖಿಕವಾಗಿ ಹೇಳಿರುವುದರಿಂದ ಹೊಸ ಪ್ಯಾಕೇಜ್ ಅಂತಿಮಗೊಳಿಸುವುದು ವಿಳಂಬವಾಗಿದೆ’ ಎಂದು ಅಧಿಕಾರಿಗಳು ಮಾಹಿತಿ ನೀಡಿದರು.

‘ಗುತ್ತಿಗೆದಾರರು ಅಕ್ರಮ ನಡೆಸಿ, ಪಾಲಿಕೆ ಹಣವನ್ನು ಲೂಟಿ ಮಾಡಿದ್ದಾರೆ. ಅಂತಹವರ ಮೇಲೆ ಕಾನೂನು ಕ್ರಮ ತೆಗೆದುಕೊಳ್ಳದೆ, ಬಿಲ್ಗಳನ್ನು ಬಿಡುಗಡೆ ಮಾಡಲಾಗುತ್ತಿದೆ. ಉಪ ಮುಖ್ಯಮಂತ್ರಿ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್ ಅವರಿಗೆ ತಪ್ಪು ಮಾಹಿತಿ ನೀಡಿ ದಿಕ್ಕು ತಪ್ಪಿಸುತ್ತಿದ್ದಾರೆ. ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರೇ ಅವರನ್ನು ಸುತ್ತುವರಿದಿದ್ದು, ನಿಯಮಗಳಂತೆ ಕೆಲಸ ಮಾಡುತ್ತಿರುವ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಸಮಸ್ಯೆ ನೀಡಲಾಗುತ್ತಿದೆ. ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕ್ರಿಮಿನಲ್ ಕ್ರಮ ಕೈಗೊಳ್ಳದಿದ್ದರೆ ಮುಂದೆ ಹೋರಾಟ ತೀವ್ರಗೊಳಿಸಲಾಗುತ್ತದೆ’ ಎಂದರು.
