 High Court Directs State Government on BBMP Civic Workers' Provident Fund

'₹ 180 crore PF default :Take Decision in 60 Days'

Bengaluru: The High Court has ordered the State Government to "positively review and take an appropriate decision within 60 days" on a petition seeking action against waste management contractors who failed to remit the Provident Fund (PF) of six thousand civic workers for five and a half years.

The single-judge bench of Justice Suraj Govindaraj issued the order on Tuesday, while hearing the writ petition filed by S.N. Balasubramaniyam, General Secretary of the 'Bengaluru Mahanagara Swachhata Mathu Lari Malikarara Mathu Guttigedarara Sangha' (Bengaluru City Cleanliness, Lorry Owners and Contractors Association).

During the hearing, the bench accepted the arguments presented by the petitioner’s High Court advocate P. Prasanna Kumar and directed the Secretary of the Urban Development Department to "examine the representation submitted by the petitioners on November 12, 2025, from a positive point of view."

Prajavani Report: 'BBMP Loses ₹180 Crore to PF'

A special report was published in 'Prajavani' on November 11, under the headline, 'PF: BBMP Loses ₹180 Crore'. The report detailed that the contractors who had undertaken garbage collection, disposal, and management in the city from January 2011 to July 2017 received full payments from the BBMP. Despite this, they did not remit the PF installments of the contract-based civic workers. Taking action on this, the Employees' Provident Fund Organisation (EPFO) recovered the full amount of the installments from the BBMP, which is the original employer.

The EPFO attached more than ₹90 crore in the BBMP's account. This ₹90 crore had already been paid by the BBMP to the waste contractors. Thus, the detailed report stated that the BBMP (Greater Bengaluru Area) incurred a loss of ₹180 crore.

Association Secretary Expresses Frustration

S.N. Balasubramaniyam, General Secretary of the Bengaluru City Cleanliness, Lorry Owners and Contractors Association, had stated, "I wrote a letter to Deputy Chief Minister D.K. Shivakumar, who calls the waste disposal contractors a mafia, as well as to the Chief Minister, the BBMP Chief Commissioner, and the BSWML CEO, requesting that criminal cases be filed against the 'defaulting contractors' who violated the law by not paying PF and obstructed the social security of the civic workers, but they have taken no action."

BSWML has delayed the finalization of the tendering process because the defaulting contractors, who failed to pay the PF, are also included in the tenders for 33 packages of waste disposal.

ಬೆಂಗಳೂರು: ‘ತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ಗುತ್ತಿಗೆದಾರರು ಆರು ಸಾವಿರ ಪೌರಕಾರ್ಮಿಕರ ಐದೂವರೆ ವರ್ಷದ ಭವಿಷ್ಯ ನಿಧಿ (ಪಿಎಫ್‌) ಪಾವತಿಸದೇ ಇರುವ ಹಿನ್ನೆಲೆಯಲ್ಲಿ ಕ್ರಮ ಕೈಗೊಳ್ಳುವಂತೆ ಸಲ್ಲಿಸಲಾಗಿರುವ ಮನವಿಯನ್ನು 60 ದಿನಗಳ ಒಳಗಾಗಿ ಸಕಾರಾತ್ಮಕವಾಗಿ ಪರಿಶೀಲಿಸಿ ಸೂಕ್ತ ನಿರ್ಧಾರ ಕೈಗೊಳ್ಳಬೇಕು’ ಎಂದು ಹೈಕೋರ್ಟ್‌ ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಆದೇಶಿಸಿದೆ.

ಈ ಕುರಿತಂತೆ, ‘ಬೆಂಗಳೂರು ಮಹಾನಗರ ಸ್ವಚ್ಛತಾ ಮತ್ತು ಲಾರಿ ಮಾಲಿಕರ ಹಾಗೂ ಗುತ್ತಿಗೆದಾರರ ಸಂಘ’ದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ ಎಸ್‌.ಎನ್‌.ಬಾಲಸುಬ್ರಮಣಿಯಂ ಸಲ್ಲಿಸಿದ್ದ ರಿಟ್‌ ಅರ್ಜಿ ವಿಚಾರಣೆ ನಡೆಸಿದ ನ್ಯಾಯಮೂರ್ತಿ ಸೂರಜ್‌ ಗೋವಿಂದರಾಜ್ ಅವರಿದ್ದ ಏಕಸದಸ್ಯ ನ್ಯಾಯಪೀಠ ಮಂಗಳವಾರ ಆದೇಶಿಸಿದೆ.

ವಿಚಾರಣೆ ವೇಳೆ ಅರ್ಜಿದಾರರ ಪರ ಹೈಕೋರ್ಟ್ ವಕೀಲ ಪಿ.ಪ್ರಸನ್ನ ಕುಮಾರ್ ಮಂಡಿಸಿದ ವಾದವನ್ನು ಮಾಡಿದ ನ್ಯಾಯಪೀಠ, ‘ಅರ್ಜಿದಾರರು ತಮಗೆ 2025ರ ನವೆಂಬರ್ 12ರಂದು ಸಲ್ಲಿಸಿರುವ ಮನವಿಯನ್ನು ಧನಾತ್ಮಕ ದೃಷ್ಟಿಕೋನದಲ್ಲಿ ಪರಾಮರ್ಶಿಸಬೇಕು’ ಎಂದು ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆ ಕಾರ್ಯದರ್ಶಿಗೆ ಆದೇಶಿಸಿದೆ.

ಪ್ರಜಾವಾಣಿಯಲ್ಲಿ ವರದಿ: ‘ಪಿಎಫ್‌: ಜಿಬಿಎಗೆ ₹180 ಕೋಟಿ ನಷ್ಟ’ ಶೀರ್ಷಿಕೆಯಡಿ ‘ಪ್ರಜಾವಾಣಿ’ಯಲ್ಲಿ ನವೆಂಬರ್ 11ರಂದು ವಿಶೇಷ ವರದಿ ಪ್ರಕಟವಾಗಿತ್ತು. 2011ರ ಜನವರಿಯಿಂದ 2017ರ ಜುಲೈವರೆಗೆ ನಗರದಲ್ಲಿ ತ್ಯಾಜ್ಯ ಸಂಗ್ರಹ, ವಿಲೇವಾರಿ, ನಿರ್ವಹಣೆಯ ಗುತ್ತಿಗೆ ಪಡೆದುಕೊಂಡಿದ್ದ ಗುತ್ತಿಗೆದಾರರು, ಬಿಬಿಎಂಪಿಯಿಂದ ಸಂಪೂರ್ಣ ಹಣ ಪಡೆದುಕೊಂಡಿದ್ದಾರೆ. ಹಾಗಿದ್ದರೂ ಗುತ್ತಿಗೆ ಆಧಾರದಲ್ಲಿದ್ದ ಪೌರಕಾರ್ಮಿಕರ ಪಿಎಫ್‌ ಕಂತನ್ನು ಪಾವತಿಸಿಲ್ಲ. ಈ ಬಗ್ಗೆ ಕ್ರಮ ಕೈಗೊಂಡಿರುವ ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯ ನಿಧಿ ಸಂಘಟನೆ (ಇಪಿಎಫ್‌) ಮೂಲ ಉದ್ಯೋಗದಾತನಾಗಿರುವ ಬಿಬಿಎಂಪಿಯಿಂದಲೇ ಕಂತಿನ ಪೂರ್ಣ ಮೊತ್ತವನ್ನು ವಸೂಲಿ ಮಾಡಿದೆ.

ಬಿಬಿಎಂಪಿಯ ಖಾತೆಯಲ್ಲಿ ₹90 ಕೋಟಿಗೂ ಹೆಚ್ಚು ಮೊತ್ತ ಜಪ್ತಿ ಇಪಿಎಫ್‌ ಮಾಡಿಕೊಂಡಿದೆ. ₹90 ಕೋಟಿಯನ್ನು ಬಿಬಿಎಂಪಿ ತ್ಯಾಜ್ಯ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಪಾವತಿಸಿತ್ತು. ಹೀಗಾಗಿ, ₹180 ಕೋಟಿ ಬಿಬಿಎಂಪಿಗೆ (ಜಿಬಿಎ) ನಷ್ಟವಾಗಿದೆ ಎಂಬ ಸವಿವರ ವರದಿ ಪ್ರಕಟವಾಗಿತ್ತು.

 ‘ಪಿಎಫ್‌ ಪಾವತಿಸದೆ ಕಾನೂನು ಉಲ್ಲಂಘಿಸಿ, ಪೌರ ಕಾರ್ಮಿಕರ ಸಾಮಾಜಿಕ ಭದ್ರತೆಗೆ ಅಡ್ಡಿಯಾಗಿರುವ ‘ಡಿಫಾಲ್ಟ್‌ ಗುತ್ತಿಗೆದಾರರ’ ಮೇಲೆ ಕ್ರಿಮಿನಲ್‌ ಪ್ರಕರಣ ದಾಖಲಿಸಬೇಕು ಎಂದು ಕಸ ವಿಲೇವಾರಿ ಗುತ್ತಿಗೆದಾರರನ್ನು ಮಾಫಿಯಾ ಎನ್ನುವ ಉಪ ಮುಖ್ಯಮಂತ್ರಿ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್‌ ಹಾಗೂ ಮುಖ್ಯಮಂತ್ರಿ, ಜಿಬಿಎ ಮುಖ್ಯ ಆಯುಕ್ತರು, ಬಿಎಸ್‌ಡಬ್ಲ್ಯುಎಂಎಲ್‌ ಸಿಇಒ ಅವರಿಗೆ ಪತ್ರ ಬರೆದಿದ್ದರೂ ಅವರು ಕ್ರಮ ಕೈಗೊಂಡಿಲ್ಲ’ ಎಂದು ಬೆಂಗಳೂರು ನಗರ ಸ್ವಚ್ಛತೆ ಮತ್ತು ಲಾರಿ ಮಾಲೀಕರು–ಗುತ್ತಿಗೆದಾರರ ಸಂಘದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ ಎಸ್‌.ಎನ್‌. ಬಾಲಸುಬ್ರಮಣಿಯಂ ಹೇಳಿದ್ದರು.

ಪಿಎಫ್‌ ಪಾವತಿಸದೆ ಡಿಫಾಲ್ಟ್‌ ಆಗಿರುವ ಗುತ್ತಿಗೆದಾರರು 33 ಪ್ಯಾಕೇಜ್‌ನ ತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿಯ ಟೆಂಡರ್‌ನಲ್ಲಿರುವುದರಿಂದ ಪ್ರಕ್ರಿಯೆ ಪೂರ್ಣಗೊಳಿಸುವುದನ್ನು ಬಿಎಸ್‌ಡಬ್ಲ್ಯುಎಂಎಲ್‌ ವಿಳಂಬಗೊಳಿಸಿದೆ.
