Garbage: GBA suffers a ₹180 Crore loss

Bengaluru: The Greater Bangalore Authority (GBA) has suffered a loss of more than ₹180 crore because waste management contractors did not pay the Provident Fund (PF) for six thousand Poura Karmikas for five and a half years. However, the officials have not taken any action against the culprits.

The contractors, who were awarded contracts for waste collection, disposal, and management in the city from January 2011 to July 2017, did not pay the PF contributions for the Poura Karmikas employed under the contract, despite having received the full payment from the BBMP. In this regard, the Employees' Provident Fund Organisation (EPFO), acting on the issue, has recovered the entire due amount from the BBMP, which is the principal employer.

GBA (formerly BBMP) officials used to say that if taxes are not paid, we will 'attach' the property. The EPFO followed the same process and 'attached' over ₹90 crore from the BBMP's account. Although the BBMP challenged this twice in the High Court, its petitions were dismissed. Therefore, the EPFO has clarified that returning this money is not possible.

The 'BBMP Contract Poura Karmikas Union' had complained in 2014 about the non-payment of PF contributions. A complaint was filed again in 2017. The EPFO, which investigated the matter since then, citing several Supreme Court judgments, gave ample time for the BBMP, as the principal employer, to rectify this. However, BBMP officials did not take any action. Consequently, on January 23, 2018, the EPFO 'attached' ₹90,18,89,719 from the BBMP's account in the Canara Bank branch at the BBMP head office and instructed the bank to pay the amount. The BBMP appealed to the High Court against this, but it was dismissed. In 2024, the BBMP filed another petition in the High Court.

The High Court directed the BBMP to appeal to the PF Regional Commissioner, provide them with all kinds of documents, convince them, and obtain an order regarding the money from them. Regarding this, the PF Regional Commissioner-1, Mihir Kumar, re-examined the matter and issued an order on September 15.

He stated, "The money obtained from the BBMP account cannot be returned. They have not provided a proper explanation or documents for it." Furthermore, he ordered, "Stringent action must be taken against the contractors who have not paid the PF contributions, and all types of dues must be recovered from them legally. No kind of contract should be given to these contractors. Every month's ECR must be submitted within 60 days, confirming the payment of money into the provident fund account."

Key Points from the PF Regional Commissioner's Order

· The BBMP cannot shift the responsibility of compliance onto the contractors or entangle the Poura Karmikas in confusion.

· It has been observed that despite multiple opportunities, the BBMP has not shown commitment to providing complete information.

· Ensuring that Poura Karmikas, whether direct or contract employees, and other contract workers are covered under the provident fund is a primary duty of the BBMP.

· The BBMP has stated that 37 contractors are not registered under the EPF Act but has failed to provide comprehensive documents as per the High Court's instruction.

· Although the BBMP claims that 7,400 solid waste management employees are on record, it has not provided their EPF account numbers, including their date of joining.

· The BBMP's claim of having paid the overall salary does not justify its failure to register eligible employees and provide them with legal benefits.

Waste Disposal Without Workers!

The BBMP claimed that there were no Poura Karmikas for waste disposal and collection in the East, South, Yelahanka, and Dasarahalli zones from January to December 2017. The PF enforcement officers have stated this is "impossible." Furthermore, they said, "The claim that there were no workers for waste collection and disposal in Yelahanka and Dasarahalli zones from March 2014 to March 2017 is false information. The failure to register six thousand Poura Karmikas under the EPF and MP Act is an extremely serious lapse."

ಬೆಂಗಳೂರು: ತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ಗುತ್ತಿಗೆದಾರರು ಆರು ಸಾವಿರ ಪೌರಕಾರ್ಮಿಕರಿಗೆ ಐದೂವರೆ ವರ್ಷ ಭವಿಷ್ಯ ನಿಧಿ (ಪಿಎಫ್‌) ಪಾವತಿಸದ್ದರಿಂದ, ಗ್ರೇಟರ್‌ ಬೆಂಗಳೂರು ಪ್ರಾಧಿಕಾರಕ್ಕೆ (ಜಿಬಿಎ) ₹180 ಕೋಟಿಗೂ ಹೆಚ್ಚು ನಷ್ಟವಾಗಿದೆ. ಆದರೂ, ತಪ್ಪಿತಸ್ಥರ ಮೇಲೆ ಅಧಿಕಾರಿಗಳು ಕ್ರಮ ಕೈಗೊಂಡಿಲ್ಲ.

2011ರ ಜನವರಿಯಿಂದ 2017ರ ಜುಲೈವರೆಗೆ ನಗರದಲ್ಲಿ ತ್ಯಾಜ್ಯ ಸಂಗ್ರಹ, ವಿಲೇವಾರಿ, ನಿರ್ವಹಣೆಯ ಗುತ್ತಿಗೆ ಪಡೆದುಕೊಂಡಿದ್ದ ಗುತ್ತಿಗೆದಾರರು, ಬಿಬಿಎಂಪಿಯಿಂದ ಸಂಪೂರ್ಣ ಹಣ ಪಡೆದುಕೊಂಡಿದ್ದರೂ, ಗುತ್ತಿಗೆ ಆಧಾರದಲ್ಲಿದ್ದ ಪೌರಕಾರ್ಮಿಕರ ಪಿಎಫ್‌ ಕಂತನ್ನು ಪಾವತಿಸಿಲ್ಲ. ಈ ಬಗ್ಗೆ ಕ್ರಮ ಕೈಗೊಂಡಿರುವ ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯ ನಿಧಿ ಸಂಘಟನೆ (ಇಪಿಎಫ್‌), ಮೂಲ ಉದ್ಯೋಗದಾತನಾಗಿರುವ ಬಿಬಿಎಂಪಿಯಿಂದಲೇ ಕಂತಿನ ಪೂರ್ಣ ಮೊತ್ತವನ್ನು ವಸೂಲಿ ಮಾಡಿದೆ.

ತೆರಿಗೆ ಕಟ್ಟದಿದ್ದರೆ ಆಸ್ತಿಯನ್ನು ‘ಅಟ್ಯಾಚ್‌’ ಮಾಡಿಕೊಳ್ಳುತ್ತೇವೆ ಎಂದು ಜಿಬಿಎ (ಹಿಂದಿನ ಬಿಬಿಎಂಪಿ) ಅಧಿಕಾರಿಗಳು ಹೇಳುತ್ತಿದ್ದರು. ಅದೇ ಪ್ರಕ್ರಿಯೆಯನ್ನು ಇಪಿಎಫ್‌ ನಡೆಸಿದ್ದು, ಬಿಬಿಎಂಪಿಯ ಖಾತೆಯಲ್ಲಿ ₹90 ಕೋಟಿಗೂ ಹೆಚ್ಚು ಹಣವನ್ನು ‘ಅಟ್ಯಾಚ್‌’ ಮಾಡಿಕೊಂಡಿದೆ. ಇದನ್ನು ಪ್ರಶ್ನಿಸಿ ಬಿಬಿಎಂಪಿ ಎರಡು ಬಾರಿ ಹೈಕೋರ್ಟ್‌ ಮೆಟ್ಟಿಲೇರಿದ್ದರೂ, ಅರ್ಜಿ ವಜಾಗೊಂಡಿದೆ. ಹೀಗಾಗಿ, ಈ ಹಣವನ್ನು ವಾಪಸ್‌ ನೀಡುವುದು ಸಾಧ್ಯವಿಲ್ಲ ಎಂದು ಇಪಿಎಫ್‌ ಸ್ಪಷ್ಟಪಡಿಸಿದೆ.

‘ಬಿಬಿಎಂಪಿ ಗುತ್ತಿಗೆ ಪೌರಕಾರ್ಮಿಕರ ಸಂಘ’ದಿಂದ 2014ರಲ್ಲಿ ಪಿಎಫ್‌ ಕಂತು ಪಾವತಿಯಾಗದ ಬಗ್ಗೆ ದೂರು ನೀಡಲಾಗಿತ್ತು. 2017ರಲ್ಲಿ ಮತ್ತೆ ಈ ಬಗ್ಗೆ ದೂರು ದಾಖಲಾಯಿತು. ಅಂದಿನಿಂದ ತನಿಖೆ ನಡೆಸಿದ ಇಪಿಎಫ್‌, ಗುತ್ತಿಗೆದಾರರಿಗಿಂತ ಮೂಲ ಉದ್ಯೋಗದಾತರಾಗಿರುವ ಬಿಬಿಎಂಪಿಯೇ ಇದನ್ನು ಸರಿಪಡಿಸಬೇಕು ಎಂದು ಸುಪ್ರೀಂ ಕೋರ್ಟ್‌ನ ಹಲವು ತೀರ್ಪುಗಳನ್ನು ಉಲ್ಲೇಖಿಸಿ ಸಾಕಷ್ಟು ಸಮಯ ನೀಡಿತ್ತು. ಆದರೆ, ಈ ಬಗ್ಗೆ ಬಿಬಿಎಂಪಿ ಅಧಿಕಾರಿಗಳು ಯಾವುದೇ ಕ್ರಮ ಕೈಗೊಂಡಿರಲಿಲ್ಲ. ಹೀಗಾಗಿ, ಕೆನರಾ ಬ್ಯಾಂಕ್‌ನ ಬಿಬಿಎಂಪಿ ಕೇಂದ್ರ ಕಚೇರಿಯ ಶಾಖೆಯಲ್ಲಿರುವ ಬಿಬಿಎಂಪಿ ಖಾತೆಯಿಂದ ₹90,18,89,719 ಅನ್ನು 2018ರ ಜನವರಿ 23ರಂದು ಇಪಿಎಫ್‌ ‘ಅಟ್ಯಾಚ್‌’ ಮಾಡಿ, ಹಣ ಪಾವತಿಸುವಂತೆ ಬ್ಯಾಂಕ್‌ಗೆ ಸೂಚಿಸಿತು. ಇದನ್ನು ಪ್ರಶ್ನಿಸಿ ಬಿಬಿಎಂಪಿ, ಹೈಕೋರ್ಟ್‌ಗೆ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿದರೂ ಅದು ವಜಾಗೊಂಡಿತು. 2024ರಲ್ಲಿ ಹೈಕೋರ್ಟ್‌ಗೆ ಬಿಬಿಎಂಪಿ ಮತ್ತೆ ಅರ್ಜಿ ಸಲ್ಲಿಸಿತು.

ಪಿಎಫ್‌ ಪ್ರಾದೇಶಿಕ ಆಯುಕ್ತರಲ್ಲಿ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿ, ಅವರಿಗೆ ಎಲ್ಲ ರೀತಿಯ ದಾಖಲೆಗಳನ್ನು ಒದಗಿಸಿ, ಮನವರಿಕೆ ಮಾಡಿಕೊಟ್ಟು, ಹಣದ ಬಗ್ಗೆ ಅವರಿಂದಲೇ ಆದೇಶ ಪಡೆದುಕೊಳ್ಳುವಂತೆ ಹೈಕೋರ್ಟ್‌ ಆದೇಶಿಸಿತು. ಈ ಬಗ್ಗೆ, ಮರು ವಿಚಾರಣೆ ನಡೆಸಿದ ಪಿಎಫ್‌ ಪ್ರಾದೇಶಿಕ ಆಯುಕ್ತ–1 ಮಿಹಿರ್‌ ಕುಮಾರ್‌ ಅವರು, ಸೆಪ್ಟೆಂಬರ್‌ 15ರಂದು ಆದೇಶ ನೀಡಿದ್ದಾರೆ.

‘ಬಿಬಿಎಂಪಿ ಖಾತೆಯಿಂದ ಪಡೆದಿರುವ ಹಣವನ್ನು ವಾಪಸ್‌ ನೀಡಲು ಆಗುವುದಿಲ್ಲ. ಅದಕ್ಕೆ ಸೂಕ್ತ ವಿವರಣೆ, ದಾಖಲೆಗಳನ್ನು ಒದಗಿಸಿಲ್ಲ’ ಎಂದು ತಿಳಿಸಿದ್ದಾರೆ. ಅಲ್ಲದೆ, ‘ಪಿಎಫ್‌ ಕಂತು ಪಾವತಿಸದ ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕಠಿಣ ಕ್ರಮ ಕೈಗೊಂಡು, ಕಾನೂನಾತ್ಮಕವಾಗಿ ಎಲ್ಲ ರೀತಿಯ ಬಾಕಿಯನ್ನು ಅವರಿಂದಲೇ ವಸೂಲಿ ಮಾಡಬೇಕು. ಈ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಯಾವುದೇ ರೀತಿಯ ಗುತ್ತಿಗೆಯನ್ನೂ ನೀಡಬಾರದು. ಭವಿಷ್ಯ ನಿಧಿ ಖಾತೆಗೆ ಹಣ ಸಂದಾಯವಾಗಿರುವ ಬಗ್ಗೆ ಪ್ರತಿ ತಿಂಗಳ ಇಸಿಆರ್‌ ಅನ್ನು 60 ದಿನದೊಳಗೆ ಸಲ್ಲಿಸಬೇಕು’ ಎಂದು ಆದೇಶಿಸಿದ್ದಾರೆ.

 

ಪಿಎಫ್‌ ಪ್ರಾದೇಶಿಕ ಆಯುಕ್ತ ಆದೇಶದ ಪ್ರಮುಖಾಂಶ

* ಬಿಬಿಎಂಪಿ ಅನುಸರಣೆಯ ಜವಾಬ್ದಾರಿಯನ್ನು ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ವರ್ಗಾಯಿಸಲು ಹಾಗೂ ಪೌರ ಕಾರ್ಮಿಕರನ್ನು ಗೊಂದಲದಲ್ಲಿ ಸಿಲುಕಿಸಲು ಸಾಧ್ಯವಿಲ್ಲ.

* ಹಲವು ಅವಕಾಶಗಳನ್ನು ನೀಡಿದ್ದರೂ ಸಂಪೂರ್ಣ ಮಾಹಿತಿಯನ್ನು ಒದಗಿಸುವ ಬದ್ಧತೆಯನ್ನು ಬಿಬಿಎಂಪಿ ಹೊಂದಿಲ್ಲ ಎಂದು ಅರಿವಾಗಿದೆ

* ನೇರ ಅಥವಾ ಗುತ್ತಿಗೆಯಲ್ಲಿರುವ ಪೌರಕಾರ್ಮಿಕರು ಹಾಗೂ ಇತರ ಗುತ್ತಿಗೆದಾರ ಉದ್ಯೋಗಿಗಳಿಗೆ ಭವಿಷ್ಯ ನಿಧಿ ಸೇರುವಂತೆ ಮಾಡುವುದು ಬಿಬಿಎಂಪಿಯ ಆದ್ಯ ಕರ್ತವ್ಯವಾಗಿದೆ

* 37 ಗುತ್ತಿಗೆದಾರರು ಇಪಿಎಫ್‌ ಕಾಯ್ದೆಯಡಿ ನೋಂದಣಿಯಾಗಿಲ್ಲ ಎಂದು ಬಿಬಿಎಂಪಿ ತಿಳಿಸಿದೆ. ಹೈಕೋರ್ಟ್‌ ಸೂಚನೆಯಂತೆ ಸಮಗ್ರ ದಾಖಲೆಗಳನ್ನು ಒದಗಿಸುವಲ್ಲಿ ವಿಫಲವಾಗಿದೆ

* 7400 ಘನತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ಉದ್ಯೋಗಿಗಳು ದಾಖಲೆಯಲ್ಲಿದ್ದಾರೆ ಎಂದು ಬಿಬಿಎಂಪಿ ಹೇಳಿದ್ದರೂ, ಅವರು ಕೆಲಸಕ್ಕೆ ಸೇರಿಕೊಂಡ ದಿನದ ವಿವರ ಸೇರಿದಂತೆ ಇಪಿಎಫ್‌ ಖಾತೆ ಸಂಖ್ಯೆಯನ್ನು ಒದಗಿಸಿಲ್ಲ.

* ಒಟ್ಟಾರೆ ವೇತನವನ್ನು ನೀಡಲಾಗಿದೆ ಎಂದು ಬಿಬಿಎಂಪಿ ಹೇಳಿಕೊಂಡಿದ್ದರೂ, ಅರ್ಹ ಉದ್ಯೋಗಿಗಳನ್ನು ನೋಂದಣಿ ಮಾಡಿಸುವಲ್ಲಿ, ಕಾನೂನುಬದ್ಧವಾದ ಸೌಲಭ್ಯಗಳನ್ನು ಕೊಡಿಸುವಲ್ಲಿ ವಿಫಲವಾಗಿರುವುದಕ್ಕೆ ಇದು ಸಮರ್ಥನೆಯಾಗುವುದಿಲ್ಲ.

 2017ರ ಜನವರಿಯಿಂದ ಡಿಸೆಂಬರ್‌ವರೆಗೆ ಪೂರ್ವ, ದಕ್ಷಿಣ, ಯಲಹಂಕ ಮತ್ತು ದಾಸರಹಳ್ಳಿ ವಲಯದಲ್ಲಿ ತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿ, ಸಂಗ್ರಹಕ್ಕೆ ಪೌರಕಾರ್ಮಿಕರೇ ಇರಲಿಲ್ಲ ಎಂದು  ಬಿಬಿಎಂಪಿ ಹೇಳಿದೆ. ಇದು ಅಸಾಧ್ಯವಾದದು ಎಂದು ಪಿಎಫ್‌ನ ಜಾರಿ ಅಧಿಕಾರಿಗಳು ಹೇಳಿದ್ದಾರೆ.  ಅಷ್ಟೇ ಅಲ್ಲ, ‘ಯಲಹಂಕ ಮತ್ತು ದಾಸರಹಳ್ಳಿ ವಲಯದಲ್ಲಿ 2014ರ ಮಾರ್ಚ್‌ನಿಂದ 2017ರ ಮಾರ್ಚ್‌ವರೆಗೆ ಕಸ ಸಂಗ್ರಹ, ವಿಲೇವಾರಿಗೆ ಕಾರ್ಮಿಕರೇ ಇರಲಿಲ್ಲ ಎಂದು ಹೇಳಿರುವುದು ತಪ್ಪು ಮಾಹಿತಿ. ಆರು ಸಾವಿರ ಪೌರ ಕಾರ್ಮಿಕರನ್ನು ಇಪಿಎಫ್‌ ಮತ್ತು ಎಂಪಿ ಕಾಯ್ದೆಯನುಸಾರ ನೋಂದಣಿ ಮಾಡಿಕೊಂಡಿಲ್ಲ. ಇದು ಅತ್ಯಂತ ಗಂಭೀರವಾದ ಲೋಪ’ ಎಂದೂ ಹೇಳಿದ್ದಾರೆ.
