Contractors who have not paid PF cannot be given contracts; only deposit is blocked

Even though BBMP made payments, waste management contractors did not pay PF to 6,000 civic workers between 2011 and 2017. BBMP has seized the account and kept ₹90 crore under its control. Since ₹90 crore was also paid to the contractors, the current Greater Bangalore Authority (GBA) has suffered a loss of more than ₹180 crore.
EPFO had seized Rs 90 crore from the BBMP account on October 10, 2017 and imposed penalty under Sections 14B and 7Q of the EPF Act and also ordered the Bangalore Regional Provident Fund Commissioner on September 15, 2025 to recover interest on the amount due. It had also ordered that legal costs be recovered from the contractors who had not paid their PF and that no contract should be awarded to them.
Against this order, the five newly formed municipal corporations have filed an appeal before the Central Government Industrial Tribunal/Labour Tribunal (CGIT). The court, considering the same, has directed that no action under Sections 14B and 7Q (Part C of the order) should be taken till January 29, 2026. However, no stay order has been issued against the order not to give new contracts to ‘default’ contractors who have not paid PF (Part H of the order).
‘Although there is no stay on the EPFO order not to take action against contractors and not to give them new contracts,’ the contractors’ association has complained.
‘The tender period for the 33 garbage package has expired and the process is underway. There are many problems to finalize it. An appeal has been filed against the EPFO order. In it, a stay order was issued only regarding the seizure of the BBMP (GBA) account. We have not asked for a stay order regarding the action taken against the contractors, nor have they given one. Therefore, there is still no clarity on whether the ‘default’ contractors should be considered in the 33 package or not,’ said officials of Bangalore Solid Waste Management Limited (BSWML).

‘Some contractors were listed as default contractors for not paying PF contributions, and some contractors who did not submit documents were listed as ‘non-compliant’. Some had demanded that they be disqualified from the tender process. However, the confusion has been cleared as CGIT has granted the appeal of five municipal corporations,’ said Venkatesh, a contractor from Goripalya.

‘CGIT has only stayed the release of deposit money and the imposition of penalty on it. It has not said anything about disciplinary action against contractors. Some contractors are going astray. Contractors who have misused ₹90 crore of public money should not be given new contracts. Also, a criminal case should be registered against such people. BSWML officials are reluctant to take action even after two months of the EPFO order. Whoever the official is, ₹90 crore is public money and it should not be misused,' said S.N. Balasubramaniam, general secretary of the Bangalore Urban Cleanliness and Lorry Owners-Contractors Association.

ಬೆಂಗಳೂರು: ನಗರದಲ್ಲಿ ತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿಗೆ ಹೊಸ ಪ್ಯಾಕೇಜ್ ಅನುಷ್ಠಾನ ಎರಡೂವರೆ ವರ್ಷದಿಂದ ಮುಂದಕ್ಕೆ ಹೋಗುತ್ತಲೇ ಇದೆ. ಭವಿಷ್ಯ ನಿಧಿ (ಪಿಎಫ್) ಪಾವತಿಸದ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಹೊಸ ಗುತ್ತಿಗೆ ನೀಡುವಂತಿಲ್ಲ ಎಂಬ ‘ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯನಿಧಿ ಸಂಘಟನೆ’ಯ (ಇಪಿಎಫ್ಒ) ಆದೇಶದಿಂದ 33 ಕಸದ ಪ್ಯಾಕೇಜ್ ಅಂತಿಮಗೊಳ್ಳಲು ಇನ್ನಷ್ಟು ವಿಳಂಬವಾಗಲಿದೆ.
ಬಿಬಿಎಂಪಿ ಪಾವತಿ ಮಾಡಿದ್ದರೂ ತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ಗುತ್ತಿಗೆದಾರರು ಆರು ಸಾವಿರ ಪೌರಕಾರ್ಮಿಕರಿಗೆ 2011–ರಿಂದ 2017ರ ಅವಧಿಯಲ್ಲಿ ಪಿಎಫ್ ಪಾವತಿಸಿರಲಿಲ್ಲ. ಬಿಬಿಎಂಪಿ ಖಾತೆಯನ್ನು ಜಪ್ತಿ ಮಾಡಿ ₹90 ಕೋಟಿಯನ್ನು ತನ್ನ ಅಧೀನದಲ್ಲಿಸಿರಿಸಿಕೊಂಡಿದೆ. ಗುತ್ತಿಗೆದಾರರಿಗೂ ₹90 ಕೋಟಿಯನ್ನು ಪಾವತಿಸಿರುವುದದರಿಂದ, ಈಗಿನ ಗ್ರೇಟರ್ ಬೆಂಗಳೂರು ಪ್ರಾಧಿಕಾರಕ್ಕೆ (ಜಿಬಿಎ) ₹180 ಕೋಟಿಗೂ ಹೆಚ್ಚು ನಷ್ಟವಾಗಿದೆ.
ಇಪಿಎಫ್ಒ 2017ರ ಅಕ್ಟೋಬರ್ 10ರಂದು ₹90 ಕೋಟಿ ಹಣವನ್ನು ಬಿಬಿಎಂಪಿ ಖಾತೆಯಿಂದ ಜಪ್ತಿ ಮಾಡಿಕೊಂಡಿದ್ದು, ಇಪಿಎಫ್ ಕಾಯ್ದೆ ಸೆಕ್ಷನ್ 14ಬಿ ಮತ್ತು 7ಕ್ಯೂನಂತೆ ದಂಡ ವಿಧಿಸುವ ಕೈಗೊಂಡು, ವಿಳಂಬಕ್ಕಾದ ಬಡ್ಡಿಯನ್ನೂ ವಸೂಲಿ ಮಾಡುವಂತೆ ಬೆಂಗಳೂರು ಪ್ರಾದೇಶಿಕ ಭವಿಷ್ಯ ನಿಧಿ ಆಯುಕ್ತರು 2025ರ ಸೆಪ್ಟೆಂಬರ್ 15ರಂದು ಆದೇಶ ಹೊರಡಿಸಿದ್ದಾರೆ. ಜೊತೆಗೆ, ಪಿಎಫ್ ಪಾವತಿಸದ ಗುತ್ತಿಗೆದಾರರಿಂದ ಕಾನೂನು ಪ್ರಕ್ರಿಯೆಯ ಶುಲ್ಕವನ್ನು ವಸೂಲಿ ಮಾಡಿಕೊಂಡು, ಅವರಿಗೆ ಯಾವುದೇ ರೀತಿಯ ಗುತ್ತಿಗೆಯನ್ನು ನೀಡಬಾರದು ಎಂದು ಆದೇಶಿಸಿದ್ದರು.
ಈ ಆದೇಶದ ವಿರುದ್ಧ, ಹೊಸದಾಗಿ ರಚನೆಯಾಗಿರುವ ಐದೂ ನಗರ ಪಾಲಿಕೆಗಳು ಕೇಂದ್ರ ಸರ್ಕಾರದ ಕೈಗಾರಿಕಾ ನ್ಯಾಯಮಂಡಳಿ/ ಕಾರ್ಮಿಕ ನ್ಯಾಯಾಲಯಕ್ಕೆ (ಸಿಜಿಐಟಿ) ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಿವೆ. ಇದನ್ನು ಪರಿಗಣಿಸಿರುವ ನ್ಯಾಯಾಲಯ, 2026ರ ಜನವರಿ 29ರವರೆಗೆ ಸೆಕ್ಷನ್ 14ಬಿ ಮತ್ತು 7 ಕ್ಯೂನಂತೆ (ಆದೇಶದ ಸಿ ಅಂಶ) ಯಾವುದೇ ಕ್ರಮ ಕೈಗೊಳ್ಳಬಾರದು ಎಂದು ಸೂಚಿಸಿದೆ. ಆದರೆ, ಪಿಎಫ್ ಪಾವತಿಸದ ‘ಡಿಫಾಲ್ಟ್’ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಹೊಸ ಗುತ್ತಿಗೆ ನೀಡಬಾರದು (ಆದೇಶದ ಎಚ್ ಅಂಶ) ಎಂಬ ಆದೇಶಕ್ಕೆ ಯಾವುದೇ ತಡೆಯಾಜ್ಞೆ ಸಿಕ್ಕಿಲ್ಲ.
‘ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕ್ರಮ ಹಾಗೂ ಅವರಿಗೆ ಹೊಸ ಗುತ್ತಿಗೆ ನೀಡಬಾರದು’ ಎಂಬ ಇಪಿಎಫ್ಒ ಆದೇಶಕ್ಕೆ ತಡೆ ಇಲ್ಲದಿದ್ದರೂ, ಕೆಲವು ಗುತ್ತಿಗೆದಾರರು ‘ಗುತ್ತಿಗೆದಾರರು ನಿರಾಳ’ ಎಂಬ ಸುದ್ದಿಗಳನ್ನು ಹಬ್ಬಿಸುತ್ತಿದ್ದಾರೆ’ ಎಂದು ಗುತ್ತಿಗೆದಾರರ ಸಂಘವೇ ದೂರಿದೆ.
‘33 ಕಸದ ಪ್ಯಾಕೇಜ್ ಟೆಂಡರ್ ಅವಧಿ ಮುಗಿದು, ಪ್ರಕ್ರಿಯೆ ನಡೆಯುತ್ತಿದೆ. ಇದನ್ನು ಅಂತಿಮಗೊಳಿಸಲು ಸಾಕಷ್ಟು ಸಮಸ್ಯೆಗಳು ಎದುರಾಗಿವೆ. ಇಪಿಎಫ್ಒ ಆದೇಶ ವಿರುದ್ಧ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಲಾಗಿದೆ. ಅದರಲ್ಲಿ ಬಿಬಿಎಂಪಿ (ಜಿಬಿಎ) ಖಾತೆ ಜಪ್ತಿಯ ಬಗ್ಗೆ ಮಾತ್ರ ತಡೆಯಾಜ್ಞೆ ಸಿಕ್ಕಿದ. ಗುತ್ತಿಗೆದಾರರ ಮೇಲಿನ ಕ್ರಮದ ಬಗ್ಗೆ ತಡೆಯಾಜ್ಞೆಗೆ ನಾವೆಲ್ಲೂ ಕೇಳಿಲ್ಲ, ಅವರು ಕೊಟ್ಟೂ ಇಲ್ಲ. ಹೀಗಾಗಿ, ‘ಡಿಫಾಲ್ಟ್’ ಗುತ್ತಿಗೆದಾರರನ್ನು 33 ಪ್ಯಾಕೇಜ್ನಲ್ಲಿ ಪರಿಗಣಿಸಬೇಕೇ, ಬೇಡವೇ ಎಂಬ ಬಗ್ಗೆ ಇನ್ನೂ ಸ್ಪಷ್ಟತೆ ಸಿಕ್ಕಿಲ್ಲ’ ಎಂದು ಬೆಂಗಳೂರು ಘನತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ನಿಯಮಿತದ (ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್) ಅಧಿಕಾರಿಗಳು ತಿಳಿಸಿದರು.
ಇಪಿಎಫ್ಒ ಆದೇಶಕ್ಕೆ ನ್ಯಾಯಮಂಡಳಿಯಲ್ಲಿ ಮೇಲ್ಮನವಿ ಸಲ್ಲಿಸಲಾಗಿದೆ. ಗುತ್ತಿಗೆದಾರರ ವಿಷಯದಲ್ಲಿ ಕಾನೂನು ತಜ್ಞರ ಜೊತೆ ಚರ್ಚೆ ನಡೆಯುತ್ತಿದೆ

‘ಕೆಲವು ಗುತ್ತಿಗೆದದಾರು ಪಿಎಫ್ ವಂತಿಗೆ ಪಾವತಿಸಿಲ್ಲವೆಂದು ಡಿಫಾಲ್ಟ್ ಗುತ್ತಿಗೆದಾರರೆಂದು ಪಟ್ಟಿ ಮಾಡಿ, ದಾಖಲೆ ಸಲ್ಲಿಸದ ಕೆಲವು ಗುತ್ತಿಗೆದಾರರನ್ನು ‘ನಾನ್–ಕಂಪ್ಲೈಯನ್ಸ್’ ಎಂದು ಪಟ್ಟಿ ಮಾಡಲಾಗಿತ್ತು. ಇವರನ್ನು ಟೆಂಡರ್ ಪ್ರಕ್ರಿಯೆಯಲ್ಲಿ ಅನರ್ಹಗೊಳಿಸಬೇಕು ಎಂದು ಕೆಲವರು ಆಗ್ರಹಿಸಿದ್ದರು. ಆದರೆ, ಐದು ನಗರ ಪಾಲಿಕೆಗಳ ಮೇಲ್ಮನವಿಯನ್ನು ಸಿಜಿಐಟಿ ಪುರಸ್ಕರಿಸಿದ್ದು ಗೊಂದಲ ನಿವಾರಣೆಯಾಗಿದೆ’ ಎಂದು ಗೋರಿಪಾಳ್ಯದ ಗುತ್ತಿಗೆದಾರ ವೆಂಕಟೇಶ್ ತಿಳಿಸಿದರು.
ಹಣ ಉಳಿಸಲು ತಾತ್ಸಾರ: ಬಾಲಸುಬ್ರಮಣಿಯಂ
‘ಸಿಜಿಐಟಿ ಠೇವಣಿ ಹಣ ಬಿಡುಗಡೆ ಹಾಗೂ ಅದರ ಮೇಲಿನ ದಂಡ ವಿಧಿಸಲು ಮಾತ್ರ ತಡೆ ನೀಡಿದೆ. ಗುತ್ತಿಗೆದಾರರ ಮೇಲಿನ ಶಿಸ್ತುಕ್ರಮದ ಬಗ್ಗೆ ಏನೂ ಹೇಳಿಲ್ಲ. ಕೆಲವು ಗುತ್ತಿಗೆದಾರರು ಹಾದಿ ತಪ್ಪಿಸುತ್ತಿದ್ದಾರೆ. ₹90 ಕೋಟಿ ಸಾರ್ವಜನಿಕರ ಹಣವನ್ನು ದುರುಪಯೋಗಪಡಿಸಿಕೊಂಡಿರುವ ಗುತ್ತಿಗೆದಾರರಿಗೆ ಹೊಸ ಗುತ್ತಿಗೆ ನೀಡಲೇಬಾರದು. ಅಲ್ಲದೆ, ಅಂತಹವರ ಮೇಲೆ ಕ್ರಿಮಿನಲ್ ಪ್ರಕರಣವನ್ನೇ ದಾಖಲಿಸಬೇಕು. ಇಪಿಎಫ್ಒ ಆದೇಶ ನೀಡಿ ಎರಡು ತಿಂಗಳಾದರೂ ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್ ಅಧಿಕಾರಿಗಳು ಕ್ರಮ ಕೈಗೊಳ್ಳಲು ತಾತ್ಸಾರದಿಂದ ಇದ್ದಾರೆ. ಯಾರೇ ಅಧಿಕಾರಿ ಇರಲಿ, ಬರಲಿ ₹90 ಕೋಟಿ ಸಾರ್ವಜನಿಕರ ಹಣವಾಗಿದ್ದು ಅದು ದುರುಪಯೋಗವಾಗಬಾರದು’ ಎಂದು ಬೆಂಗಳೂರು ನಗರ ಸ್ವಚ್ಛತೆ ಮತ್ತು ಲಾರಿ ಮಾಲೀಕರು–ಗುತ್ತಿಗೆದಾರರ ಸಂಘದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ ಎಸ್.ಎನ್. ಬಾಲಸುಬ್ರಮಣಿಯಂ ಹೇಳಿದರು.
