Bengaluru: The issue of non-payment of provident fund (PF) installments to six thousand poura karmikas will become a hurdle for the tender for waste disposal of 33 packages.

When BBMP was in power, a tender with an estimated cost of ₹544.91 crore was called for comprehensive waste disposal in the assembly. After various legal conflicts, the tender has been opened and the final process is underway.

In this context, the regional commissioner of the Employees' Provident Fund Organization has issued an order on September 15 that no new tender should be awarded to waste management contractors ('defaulters') who have not paid their PF installments. The 'default' contractors have also submitted bids for 33 packages. It is said that only one ‘default’ contractor has submitted a bid in some packages.

The BBMP itself had submitted a detailed report to the Employees’ Provident Fund Organisation (EPF) requesting action to be taken against the contractors who have ‘defaulted’ without paying PF. They had also informed them to take necessary action against 34 contractors in Yelahanka, Mahadevapura, Bommanahalli, South and East zones. The EPF has ordered the GBA (BBMP) to ‘take legal action against the contractors and not give them any contracts’. Thus, the officials of the Bangalore Solid Waste Management Limited (BSWML) are in a dilemma as to whether or not to take action against the contractors who have ‘defaulted’ in the new package.

The Bangalore Urban Cleanliness and Lorry Owners-Contractors Association has said that the ‘default’ contractors should be dropped from the tenders for 33 packages, otherwise legal action will be taken, which has created a situation where the waste disposal package has not been finalized and has to face legal action again.

‘A criminal case should be registered against the ‘default contractors’ who are violating the law by not paying PF and obstructing the social security of civic workers,’ demanded S.N. Balasubramaniam, general secretary of the Bangalore Urban Cleanliness and Lorry Owners-Contractors Association.

‘The default contractors have misused government and public money. Civic workers have been cheated. In this regard, a letter has been written to Governor Thawar Chand Gehlot, Chief Minister Siddaramaiah, Deputy Chief Minister D.K. Shivakumar, GBA Chief Commissioner and other senior officials. If they do not take appropriate action, legal action will be taken, he said.

ಬೆಂಗಳೂರು: ಆರು ಸಾವಿರ ಪೌರ ಕಾರ್ಮಿಕರಿಗೆ ಭವಿಷ್ಯ ನಿಧಿ (ಪಿಎಫ್‌) ಕಂತು ಪಾವತಿಸದ ವಿಷಯ, 33 ಪ್ಯಾಕೇಜ್‌ನ ತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿಯ ಟೆಂಡರ್‌ಗೆ ಕಂಟಕವಾಗಲಿವೆ.

ವಿಧಾನಸಭೆವಾರು ಸಮಗ್ರ ತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿಗೆ ಬಿಬಿಎಂಪಿಯಿದ್ದಾಗ ವಾರ್ಷಿಕ ₹544.91 ಕೋಟಿ ಅಂದಾಜು ವೆಚ್ಚದ ಟೆಂಡರ್‌ ಕರೆಯಲಾಗಿತ್ತು. ಹಲವು ರೀತಿಯ ಕಾನೂನು ಸಂಘರ್ಷದ ನಂತರ, ಟೆಂಡರ್ ತೆರೆದು, ಅಂತಿಮ ಪ್ರಕ್ರಿಯೆ ನಡೆಯುತ್ತಿದೆ.

ಈ ಸಂದರ್ಭದಲ್ಲೇ, ಪಿಎಫ್‌ ಕಂತು ಪಾವತಿಸದ ತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ಗುತ್ತಿಗೆದಾರರಿಗೆ (‘ಡಿಫಾಲ್ಟ್‌’) ಯಾವುದೇ ಹೊಸ ಟೆಂಡರ್‌ ನೀಡಬಾರದು ಎಂದು ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯ ನಿಧಿ ಸಂಘಟನೆಯ ಪ್ರಾದೇಶಿಕ ಆಯುಕ್ತರು ಸೆಪ್ಟೆಂಬರ್ 15ರಂದು ಆದೇಶ ಹೊರಡಿಸಿದ್ದಾರೆ. ‘ಡಿಫಾಲ್ಟ್‌’ ಗುತ್ತಿಗೆದಾರರೂ 33 ಪ್ಯಾಕೇಜ್‌ನಲ್ಲಿ ಬಿಡ್‌ ಸಲ್ಲಿಸಿದ್ದಾರೆ. ಕೆಲವು ಪ್ಯಾಕೇಜ್‌ನಲ್ಲಿ ‘ಡಿಫಾಲ್ಟ್‌’ ಗುತ್ತಿಗೆದರರೊಬ್ಬರೇ ಬಿಡ್‌ ಸಲ್ಲಿಸಿದ್ದಾರೆ ಎನ್ನಲಾಗಿದೆ.

ಪಿಎಫ್‌ ಪಾವತಿಸದೆ ‘ಡಿಫಾಲ್ಟ್‌’ ಆಗಿರುವ ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕ್ರಮ ಕೈಗೊಳ್ಳಬೇಕು ಎಂದು ಬಿಬಿಎಂಪಿಯೇ ಸವಿವರವಾಗಿ ಕಾರ್ಮಿಕರ ಭವಿಷ್ಯನಿಧಿ ಸಂಘಟನೆಗೆ (ಇಪಿಎಫ್‌) ಸಲ್ಲಿಸಿತ್ತು. ಯಲಹಂಕ, ಮಹದೇವಪುರ, ಬೊಮ್ಮನಹಳ್ಳಿ, ದಕ್ಷಿಣ ಹಾಗೂ ಪೂರ್ವ ವಲಯದಲ್ಲಿ 34 ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಅಗತ್ಯ ಕ್ರಮ ಕೈಗೊಳ್ಳಿ ಎಂದು ಅವರೆಲ್ಲ ಮಾಹಿತಿಯನ್ನೂ ನೀಡಿತ್ತು. ‘ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕಾನೂನುತ್ಮಕ ಕ್ರಮ ಕೈಗೊಂಡು, ಅವರಿಗೆ ಯಾವುದೇ ಗುತ್ತಿಗೆ ನೀಡಬಾರದು’ ಎಂದು ಜಿಬಿಎಗೆ (ಬಿಬಿಎಂಪಿ) ಇಪಿಎಫ್‌ ಆದೇಶಿಸಿದೆ. ಹೀಗಾಗಿ, ಹೊಸ ಪ್ಯಾಕೇಜ್‌ನಲ್ಲಿ ‘ಡಿಫಾಲ್ಟ್’ ಆಗಿರುವ ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕ್ರಮ ಕೈಗೊಳ್ಳಬೇಕೇ, ಬೇಡವೇ ಎಂಬ ಗೊಂದಲದಲ್ಲಿ ಬೆಂಗಳೂರು ಘನತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ನಿಯಮಿತದ (ಬಿಎಸ್‌ಡಬ್ಲ್ಯುಎಂಎಲ್‌) ಅಧಿಕಾರಿಗಳು ಮುಳುಗಿದ್ದಾರೆ.

‘ಡಿಫಾಲ್ಟ್‌’ ಗುತ್ತಿಗೆದಾರರನ್ನು 33 ಪ್ಯಾಕೇಜ್‌ಗಳ ಟೆಂಡರ್‌ನಿಂದ ಕೈಬಿಡಬೇಕು, ಇಲ್ಲದಿದ್ದರೆ ಕಾನೂನು ಹೋರಾಟ ನಡೆಸಲಾಗುತ್ತದೆ ಎಂದು ಬೆಂಗಳೂರು ನಗರ ಸ್ವಚ್ಛತೆ ಮತ್ತು ಲಾರಿ ಮಾಲೀಕರು–ಗುತ್ತಿಗೆದಾರರ ಸಂಘ ಹೇಳಿರುವುದರಿಂದ,  ತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿ ಪ್ಯಾಕೇಜ್‌ ಅಂತಿಮಗೊಳ್ಳದೆ, ಮತ್ತೆ ಕಾನೂನು ಸಂಘರ್ಷ ಎದುರಿಸಬೇಕಾದ ಸ್ಥಿತಿ ನಿರ್ಮಾಣವಾಗಿದೆ.

 

ಕ್ರಿಮಿನಲ್‌ ಮೊಕದ್ದಮೆ ಹಾಕಿ: ಸಂಘ

‘ಪಿಎಫ್‌ ಪಾವತಿಸದೆ ಕಾನೂನು ಉಲ್ಲಂಘಿಸಿ, ಪೌರ ಕಾರ್ಮಿಕರ ಸಾಮಾಜಿಕ ಭದ್ರತೆಗೆ ಅಡ್ಡಿಯಾಗಿರುವ ‘ಡಿಫಾಲ್ಟ್‌ ಗುತ್ತಿಗೆದಾರರ’ ಮೇಲೆ ಕ್ರಿಮಿನಲ್‌ ಪ್ರಕರಣ ದಾಖಲಿಸಬೇಕು’ ಎಂದು ಬೆಂಗಳೂರು ನಗರ ಸ್ವಚ್ಛತೆ ಮತ್ತು ಲಾರಿ ಮಾಲೀಕರು–ಗುತ್ತಿಗೆದಾರರ ಸಂಘದ ಪ್ರಧಾನ ಕಾರ್ಯದರ್ಶಿ ಎಸ್‌.ಎನ್‌. ಬಾಲಸುಬ್ರಮಣಿಯಂ ಆಗ್ರಹಿಸಿದರು.

‘ಡಿಫಾಲ್ಟ್‌ ಗುತ್ತಿಗೆದಾರರು ಸರ್ಕಾರ ಹಾಗೂ ಸಾರ್ವಜನಿಕರ ಹಣವನ್ನು ದುರುಪಯೋಗಪಡಿಸಿಕೊಂಡಿದ್ದಾರೆ. ಪೌರಕಾರ್ಮಿಕರಿಗೆ ವಂಚಿಸಲಾಗಿದೆ. ಈ ಬಗ್ಗೆ, ರಾಜ್ಯಪಾಲ ಥಾವರಚಂದ್‌ ಗೆಹಲೋತ್‌, ಮುಖ್ಯಮಂತ್ರಿ ಸಿದ್ದರಾಮಯ್ಯ, ಉಪ ಮುಖ್ಯಮಂತ್ರಿ ಡಿ.ಕೆ. ಶಿವಕುಮಾರ್‌, ಜಿಬಿಎ ಮುಖ್ಯ ಆಯುಕ್ತರು ಸೇರಿದಂತೆ ಹಿರಿಯ ಅಧಿಕಾರಿಗಳಿಗೆ ಈ ಬಗ್ಗೆ ಪತ್ರ ಬರೆಯಲಾಗಿದೆ. ಅವರು ಸೂಕ್ತ ಕ್ರಮ ಕೈಗೊಳ್ಳದಿದ್ದರೆ ಕಾನೂನಾತ್ಮಕವಾಗಿಯೋ ಹೋರಾಟ ನಡೆಸಲಾಗುತ್ತದೆ’ ಎಂದರು.

 

ಪಿಎಫ್‌ ‘ಡಿಫಾಲ್ಟ್‌’ ಗುತ್ತಿಗೆದಾರರ ಬಗ್ಗೆ ಇಪಿಎಫ್‌ ಆದೇಶವನ್ನು ಪರಿಶೀಲಿಸಲಾಗುತ್ತದೆ. ಅಗತ್ಯ ಕ್ರಮ ಕೈಗೊಳ್ಳಲು ಚರ್ಚೆ ನಡೆಸಲಾಗುತ್ತದೆ
