Buffer Zone Reduction for Lakes: Governor Assents to KTCDA Act Amendment

Bengaluru: A significant decision to reduce the 'Protected Area' (Buffer Zone) surrounding lakes in the state has received official approval. The Governor has granted assent to the amendment of the Karnataka Lake Conservation and Development Authority (KTCDA) Act, and the government has officially notified the revised buffer zone limits.

Background and Process

The amendment follows a report submitted by a high-level committee led by the Chief Secretary, which recommended relaxing buffer zone restrictions for lakes and primary storm-water drains (Rajakaluves).

 * August 2025: The state legislature passed the bill to amend the KTCDA Act.

 * February 16, 2026: After seeking clarifications twice, the Governor finally signed the bill into law.

 * February 18, 2026: The Department of Parliamentary Affairs and Legislation issued the formal notification regarding the revised zones.

Exemptions for Public Utilities

According to the new notification, certain public utility services are now exempt from strict buffer zone restrictions, provided they obtain prior approval from the KTCDA. These include:

 * Roads, bridges, and power lines.

 * Water supply lines, underground drainage (UGD) systems, and Sewage Treatment Plants (STP).

 * Jackwells, pump houses, Intermediate Sewage Pumping Stations (ISPS), and wet wells.

> Important Note: The notification explicitly states that no commercial, industrial, or recreational activities shall be permitted within the revised buffer zones.

New Buffer Zone Specifications

Previously, a uniform 30-meter buffer zone was mandatory for all lakes regardless of size. The new regulations categorize the buffer zone based on the lake's area:

ಬೆಂಗಳೂರು: ರಾಜ್ಯದ ಕೆರೆಗಳ ಸಂರಕ್ಷಿತ ಪ್ರದೇಶದ (ಬಫರ್‌ ವಲಯ) ವ್ಯಾಪ್ತಿಯನ್ನು ಕಡಿತಗೊಳಿಸುವ ಮಹತ್ವದ ನಿರ್ಧಾರಕ್ಕೆ ಅಧಿಕೃತ ಮುದ್ರೆ ಬಿದ್ದಿದೆ. ಕರ್ನಾಟಕ ಕೆರೆ ಸಂರಕ್ಷಣೆ ಮತ್ತು ಅಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರದ (KTCDA) ತಿದ್ದುಪಡಿ ಕಾಯ್ದೆಗೆ ರಾಜ್ಯಪಾಲರು ಅಂಕಿತ ಹಾಕಿದ್ದು, ಈ ಕುರಿತು ಸರ್ಕಾರ ಫೆಬ್ರವರಿ 18ರಂದು ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಿದೆ.

ಹಿನ್ನೆಲೆ ಮತ್ತು ಪ್ರಕ್ರಿಯೆ

ಕೆರೆ ಹಾಗೂ ರಾಜಕಾಲುವೆಗಳ ಬಫರ್ ವಲಯದ ಮಿತಿಗಳನ್ನು ಪರಿಷ್ಕರಿಸುವಂತೆ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ ನೇತೃತ್ವದ ಸಮಿತಿ ಸರ್ಕಾರಕ್ಕೆ ಶಿಫಾರಸು ಮಾಡಿತ್ತು. ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ:

 * ಆಗಸ್ಟ್ 2025: ವಿಧಾನಮಂಡಲದಲ್ಲಿ ತಿದ್ದುಪಡಿ ಮಸೂದೆಗೆ ಸಮ್ಮತಿ ಪಡೆಯಲಾಗಿತ್ತು.

 * ಫೆಬ್ರವರಿ 16, 2026: ಎರಡು ಬಾರಿ ವಿವರಣೆ ಕೇಳಿದ್ದ ರಾಜ್ಯಪಾಲರು ಅಂತಿಮವಾಗಿ ಮಸೂದೆಗೆ ಸಹಿ ಹಾಕಿದರು.

 * ಫೆಬ್ರವರಿ 18, 2026: ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳು ಮತ್ತು ಶಾಸನ ರಚನೆ ಇಲಾಖೆಯಿಂದ ಅಧಿಕೃತ ಅಧಿಸೂಚನೆ ಪ್ರಕಟವಾಯಿತು.

ಯಾವುದಕ್ಕೆ ವಿನಾಯಿತಿ ಇದೆ?

ಹೊಸ ನಿಯಮದ ಪ್ರಕಾರ, ಸಾರ್ವಜನಿಕ ಹಿತದೃಷ್ಟಿಯ ಮೂಲಸೌಕರ್ಯ ಯೋಜನೆಗಳಿಗೆ ಬಫರ್ ವಲಯದ ಕಟ್ಟುನಿಟ್ಟಿನ ನಿರ್ಬಂಧ ಇರುವುದಿಲ್ಲ. ಆದರೆ, ಕೆಟಿಸಿಡಿಎ ಇಲಾಖೆಯಿಂದ ಪೂರ್ವಾನುಮೋದನೆ ಪಡೆಯುವುದು ಕಡ್ಡಾಯವಾಗಿದೆ. ವಿನಾಯಿತಿ ಪಡೆದ ಸೇವೆಗಳು:

 * ರಸ್ತೆಗಳು, ಸೇತುವೆಗಳು ಮತ್ತು ವಿದ್ಯುತ್ ಮಾರ್ಗಗಳು.

 * ನೀರು ಸರಬರಾಜು, ಒಳಚರಂಡಿ ಮಾರ್ಗಗಳು (UGD) ಮತ್ತು ಎಸ್‌ಟಿಪಿ (STP) ಘಟಕಗಳು.

 * ಜಾಕ್‌ವೆಲ್, ಪಂಪ್‌ಹೌಸ್ ಮತ್ತು ವೆಟ್‌ವೆಲ್‌ಗಳ ನಿರ್ಮಾಣ.

> ಗಮನಿಸಿ: ಪರಿಷ್ಕೃತ ಬಫರ್ ವಲಯದಲ್ಲಿ ಯಾವುದೇ ವಾಣಿಜ್ಯ, ಕೈಗಾರಿಕಾ ಅಥವಾ ಮನರಂಜನಾ ಚಟುವಟಿಕೆಗಳನ್ನು ನಡೆಸುವಂತಿಲ್ಲ ಎಂದು ಸರ್ಕಾರ ಸ್ಪಷ್ಟಪಡಿಸಿದೆ.

ಹೊಸ ಬಫರ್ ವಲಯದ ಮಾರ್ಗಸೂಚಿ

ಈ ಹಿಂದೆ ಎಲ್ಲಾ ಗಾತ್ರದ ಕೆರೆಗಳಿಗೂ ಕಡ್ಡಾಯವಾಗಿ 30 ಮೀಟರ್ ಬಫರ್ ವಲಯವಿತ್ತು. ಈಗ ಕೆರೆಯ ವಿಸ್ತೀರ್ಣಕ್ಕೆ ಅನುಗುಣವಾಗಿ ಅದನ್ನು ಈ ಕೆಳಗಿನಂತೆ ಪರಿಷ್ಕರಿಸಲಾಗಿದೆ:
