 Bengaluru: The process of issuing trade license under BBMP has not been completed even though the 'SAKALA limit' has expired. 455 applications have not been disposed of in the health officer section of eight zones.

 Rajarajeshwarnagar has the highest number of pending trade license applications. Although more applications are pending on time in the eastern zone as well, the health officials say that the software is not correct, the portal is not correct. "Deemed to Approved is also showing in arrears," these are the given reasons.

 There is no problem with BBMP portal and software. The arrears of application should be disposed of by the concerned officer," said Nagesh of BBMP IT department.

 'Let Lokayukta investigate': 'The list of pending trade license applications is circulating on social sites, Lokayukta should focus on this and action should be taken against health officials as well'.

 Lokayukta himself recently raided the offices of revenue department of BBMP and checked the disposal of files. Similarly, in the health department, 'Sakala' applications are not being disposed of. There is a demand that this should be investigated.

Thousands of such cases have been registered in the city.

 'They say that record not given,  without getting it!'

 According to the UPOR scheme, property ownership deed, property tax payment receipt, property arrears letter, BBMP khatha, plot allotment letter, plot possession deed, copy of land conversion order/layout plan, photo of owner, photo of property should be published on the card. If they do not have all these details, they should get them from us. The person who gave the notice never came, sent the card without collecting the document and stated that it was not given. This is an irresponsible scheme. But the owners are facing difficulties,' complained Sivakumar of Kengeri.

What is UPOR?

  •  A 'UPOR Card' issued by the government is a certificate of property ownership for citizens. It also contains property map, ownership details, rights including debt, litigation and other information.
  •  In case of sale or partition of property with 'UPOR Card', the information is changed in the automated system by the office of the Deputy Registrar. If there is pressure on lake area, government property, forest area, they are clearly linked to each property. The purpose of the UPOR scheme as presented now. However, all this information is not available in the 'UPOR Card' which is available to the people. Instead, many of the details are incorrect.

 'This is a draft, document can be submitted'

 Now the draft 'UPOR Card' has been given. There have been over 7,000 complaints online about the bug. Complaints can be lodged at the K.R.circle office of the Commissioner of Land Survey, Revenue and Land Records Department UPOR. It will be checked and action will be taken. Bengaluru: Commercial activity is going on in the civic facility (CA) plot allotted for construction of school-college in the 6th block of Sir M. Visvesvaraiah Layout, BDA has decided to investigate this.

 BDA has allotted plot No.5/A CA in 6th Block to 'Poly Education Society'. 'Poly Vidyasamshthe Swathu' is written in large on the compound. But cement is being stocked at this site and tens of big trucks are parked here. The activity of transferring cement from trucks to hundreds of small lorries and tempos has been going on here for a few months.

 "The Poly Education Society, which has allotted a civic facility (CA) plot for social and educational purposes, is misusing the plot" Residents of Nuggipalya have complained that there is an activity going on here which adversely affects the health of the locals.

 The residents have written a letter to the BDA Commissioner, saying, 'Hundreds of huge cement trucks are parked on the campus of CA every day. Cement bags are replaced. Due to this, cement dust is entering the houses of local residents, the elderly are facing many kinds of problems, including breathing,' complained villagers Anilkumar, Venkatesh, Ananda, Chaitra and Ashwath.


 Day and night shouting: 

'Lorries always come and go in this place day and night. There is dust all around. Also, hundreds of laborers live here and they keep shouting throughout the night'. Chandravva, Venkatesh, Ramakrishnaiah, Sampangaiah, Kamalamma have demanded in the letter written by BDA that legal action should be taken against the Pali Education Society and the allotment of land should be cancelled.

Notice to take action: 'BDA Commissioner has given ordered to take action on the complaint. Poly Education Society has applied for the building plan. BDA officials said that the entire file is in the engineering department and they have to take action.

 Investigation to carry in 1,600 CA sites

 Bengaluru Development Authority has allotted around 1,600 CA plots in all its layouts. Such plots should be used for the purpose for which they are allocated. It is illegal to carry on commercial activities with that purpose, i.e. building a shop and taking rent from it, taking rent from sheds etc. BDA has decided to investigate the matter.

 BDA has come to the notice of commercial activities going on in CA premises in recent days. It is decided to review these in a phased manner. BDA officials said that action is being taken based on the complaints of citizens too.

Bengaluru: The Cosmopolitan Club of Jayanagar, which is facing investigation for violating the lease agreement of CA site with BDA, is likely to have its registration canceled due to violation of bylaws.

Cosmopolitan Club, which has written a cover letter to the BDA, Cooperative Department and Excise Department, has said the same in its bylaws that it will do social work. But, so far not a small social work has been done. Instead, what was said in the general meeting about 'close the trust' which is doing social work for the club... This minutes has reached the Deputy Director of Co-operative Societies.

 In the bylaws of the association (2.6) the objective of helping the needy is mentioned. However, so far no such work has been done by the club. The 'Cosmopolitan Club Corpus Fund Trust', approved by the general meeting of the club, collected money from its own donors and did social work. The system of providing free meals to thousands of people should not be continued. Also the trust should be cancelled. Social responsibility does not need to be paid for. It was discussed in the recent general meeting that the club members should use it for license renewal and it was decided. Officials said that the cooperation department is seriously examining this and has decided to start the process of canceling the registration.

 Cosmopolitan Club has been granted a 'CL-4' license at a concessional rate by the Excise Department due to the social aspects of its entry in the Register of Co-operative Societies. This license is issued with a fee of ₹7.47 lakh per annum. Excise department officials said that if the registration of cooperative societies is cancelled, the liquor license will also be cancelled.

 Bengaluru: Under BBMP, the works have been completed, the bill processes have been completed and the outstanding amount for payment has exceeded ₹6 thousand crore.

 BBMP has the power to immediately pay half of this huge amount owed to contractors. However, the order of investigations does not allow it.

 Payment is due from 2021 for works completed under BBMP grant. Payment for works funded by UNION and STATE government is to be made from 2023 onwards. For all these works, payment is due even though the CBR (Central Bill Registrar) number and date entry is the final stage of the bill.

 There is more than ₹3 thousand crore in BBMP. Almost half of the balance of ₹6,000 crore can be released immediately. This will not cause any problem for the management of the corporation. Because there are seven months left in the financial year, the revenue will accumulate,'' say BBMP officials.

 Everyone, including the BBMP Chief Commissioner, is aware of the plight of contractors. However, some works are not actually done. So everyone is under suspicion. Therefore, the officials opined that the money will be given to everyone only after the investigation.

 The central and state governments should release the grant soon. If the money in BBMP is also released, the contractor's problem will be solved," BJP Bangalore South District Unit President N.R. Ramesh said.

The government has formed four SITs to report on the reality of the workers. It is said that they will release the money after reporting. But, how will the reality of the works done in 2019 be checked now? Defects Liability Period (DLP) is only one year after completion of work. Then the contractor is not responsible for the same. However, the contractors are questioning how they will do the inspection.

 KRIDL Bill Pending:

 There is a dispute regarding the works undertaken by the Karnataka Rural Infrastructure Development Corporation and some bills have not been paid since 2018 despite CBR. The bill for such issues is ₹65.56 crore.

 A lot of requests are being made to pay for the completed works under BBMP. We took a loan and completed the hard work. Contractors are unable to undertake new works. There is no money to pay the interest on the previous loan. The interest is increasing again. Therefore, the chief minister and deputy chief minister will be met again and agreed to pay the money," said Ravindra, the working president of the BBMP Contractors Association.

 The genuineness of the work under BBMP is being questioned and investigated. We are not asking to pay those who do not do the work. Pay the bill to those who have completed the work. A report has been given under the supervision of Chief Engineer. The money should be paid accordingly. Contractors are in dire straits. Every day their burden is increasing. Loan interest, interest on interest is increasing day by day. Pay the money soon," said BBMP Working Contractors Association President K.T. Manjunath appealed.

 Bengaluru: The BDA on Tuesday issued a notice to the Cosmopolitan Club in Jayanagar third block and asked them to provide details about the violation of the lease agreement.

 BDA South Division executive engineer and revenue officers have been ordered to conduct a joint investigation at the site of the Cosmopolitan Club and submit a report within two days.

 CA (Civic Amenity) Plot No.1 (P01) Old No.22) has been allotted in favor of the Club. A complaint has been submitted to the BDA Secretary on behalf of the Bangalore Civil Rights protection Committee regarding the violation of all the conditions of the 'Official Cover Letter' written by the club to the authority. He informed that the points in the cover letter issued by the club management board at the time of approval of the building plan were violated. Its report was published in 'Prajavani' on August 22.

 Therefore, your organization must report within seven days of any breach of the lease agreement entered into with the BDA. Otherwise appropriate action will be taken as per BDA Civic Facility Plot Allotment Rules – 1989. Said the notice which is issued by the BDA Estate Officer to the Cosmopolitan Club Secretary, Cosmopolitan Club on August 22.

 BENGALURU: The government has approved an expenditure of ₹45 crore each for carrying out new works in 12 Congress MLA constituencies.

 MLAs should prepare a list of the works to be carried out and submit it to BBMP. It is suggested that those works should be carried out.

 When the Congress government came to power, all the works of BBMP were suspended. Including the assembly election period, not a single tender has been called since April. On the insistence of Congress MLAs, the government has now given permission to carry out new works.

 ₹45 crore per constituency is not a new grant. The same grants that were allowed when the BJP was in power are used here. However, now only the works mentioned by the Congress MLAs will be carried out. The BBMP officials informed that some of the previously decided works will be abandoned and new works will be carried out instead.

 There is also pressure to transfer the grant of assembly constituencies with BJP MLAs to the constituencies with Congress MLAs. As ₹45 crore work has been suggested to be carried out, the Congress MLAs are asking to adjust it in terms of stopping the works in other sectors.

The works started in the constituency with Congress MLAs during the BJP government should not be changed. Let it continue. "Now Congress MLAs are preparing a list to start new works by matching the ₹45 crore grant from other sectors," party sources said.

 Recently there has been a rapid development in the Yeshwantpur assembly constituency, with the local leaders of the BJP joining the Congress. When Somasekhar had earlier left the Congress to join the BJP, these leaders had followed him. But now the MLAs are still in the BJP but the leaders have returned to the Congress. Sources in the party said that Somashekhar may also join the Congress.

Bengaluru: The prestigious Cosmopolitan Club of Jayanagar is facing the threat of losing its recognition and space for violating the terms and conditions of the BDA.

 Construction and operation of commercial centers should be facilitated. In lieu of this, various social services including mid-day meals will be provided to the citizens of the areas surrounding the Cosmopolitan Club and to the workers working in the club, the lease agreement said. But now the social service works have been stopped.

 The Cosmopolitan Club, which has over three thousand members, was leased by the BDA for 30 years in 2000–2001. In 2009, ``Cosmopolitan Club Corpus Fund Trust'' was established for social work. Through this, many kinds of work including distribution of books and clothes were done. Many have also donated lakhs under Income Tax Act 80G.

 A lunch of the best quality including payas and ghee was served daily at the club to about a thousand people. However, it has been decided to stop this now in the meeting of all members of the club. As such, mid-day meal is not being served from August 1. By this, all the social activities have come to a standstill and it is a violation of the cover given to the BDA.

 Cosmopolitan Club, which has 69 thousand square feet of corner property, has built commercial centers as well. From this, the rent is ₹15 lakh every month. As the social functions are stopped, the rent of centers for commercial purpose should be paid to BDA. Ganesh Singh of Bengaluru Civil Rights Struggle Committee has written a letter to the BDA Commissioner that immediate action should be taken in this regard.

Under the guise of doing social work, the club is only paying a rent of ₹1 crore (about ₹27,000 per month) for 30 years for a 69,000-square-foot property. Due to breach of contract, at least ₹5 lakh per month rent will be available to BDA. The lease of this property worth more than ₹600 crore should be cancelled. He demanded that the club should be run by BDA.

 I had written the cover letter: President 

 'During the construction of a building for commercial purposes, there were a lot of legal problems. We also took another area to build a parking lot. In return for all this, I was given a letter by the club when I was the secretary to do social work. Now the social activity have stopped and it has been violated, said Kumar Raju, president of the Cosmopolitan Club.

 About one thousand people were served lunch. However, some insisted to stop this in the recent all-member general body meeting. As they all insisted, it was decided to stop serving lunch, a social works, despite my opposition. Accordingly, it has stopped', he informed.

 "We have not built the club from the beginning to be just a fun place. We are also doing social work. We have established a trust and are doing many kinds of work including books, pens and food for the poor. The trust was not given a single rupee by the club. Only space was provided for lunch. Minister Ramalingareddy and others used to give many donations. Due to this social work was going on. Despite all kinds of appeals not to stop these, a decision has been taken out of the interest of some. Kumar Raju told 'Prajavani' that, he has also informed BDA president Rakesh Singh about this and requested him to take action.

Bengaluru: Once upon a time it was thought that this lake would not survive. ₹22.4 crore is being spent on the Shreegandha Kavalu lake, which is little left due to the struggle of the locals. However, there is no way for water to flow through it.

Shreegandha Kavalu lake is being developed by BBMP Solid Waste Management Department. The solid waste management department (SWM) does have any link with lake development? that not known. However, SWM has undertaken the development works of Shrigandha Kavalu Lake, Hosakerahalli Lake, Mallattahalli Lakes under the 'Shubhra Bangalore' project.

 Due to the pressure of the citizens, many works including road construction work in Hoskerehalli lake have been stopped. The work of Mallattahalli lake is under the supervision of the High Court. However, the development work of Shreegandha Kavalu Lake will go on without any hindrance. The lake is a decorative area, without water flow.

 There are revenue records that there is Shreegandha Kavalu lake in 6 acres 33 gunte area out of Survey no. 15. Amma Bhagwan Seva Samiti Trust has encroached 7 gunte and about 3 gunte are encroached for the road. No encroachment has been cleared while developing the lake. Instead, construction of school, installation of Pure drinking water plants is done in lake yard. The canal of the Vrishabhavati valley which flows into the lake has been made to pass outside the Samiti Trust building and the school under construction.

 The developed Shreegandha Kavalu lake as such, it needs flow from land belonging to the Jaman Lal Bajaj Seva Trust adjacent to Lake. But, there is no canal there. If they build a full-scale building, not even a little water will come. The SWM lake has been developed under the 'Shubhra Bengaluru' project shows that private property as an inflow. BENGALURU: The State Pollution Control Board's CHAIRMAN has violated the laws in ordering awareness programs, according to the report of the inquiry committee appointed by the state government.

As per Water Pollution Act 1974 and Air Pollution Act 198, the CHAIRMAN of the Board has no authority to constitute any committee. It is clearly mentioned in the report that Chairman Shanth Thimmaiah has formed the single source committee in violation of acts.

State Audit and Accounts Department Additional Director Mahadeva is the investigating officer of the committee constituted by the government. It is said in the report that the decision to select a single source organization was taken with the intention of awarding contracts to the planned institutions.

 The CHAIRMAN of the board has appointed a self-proclaimed chairman of the single source organization. A committee of three experts should be constituted under the Transparency Act 1999 -4(b). The members should be experts in the same subject on the board.

 An office memorandum was issued by the CHAIRMAN himself, who constituted a single parent organization. This committee was constituted with the objective of giving approval to five organizations to give planned advertising works. Considering the proposal of five firms for advertisement worth ₹19.92 crore, four firms are considered as single source firm. As per Section 15(e) of the State Government Rules, 1976, the CHAIRMAN can approve only tenders worth ₹25 thousand in each case, the report said.

 A short term tender of 35 days could have been invited. Without considering it, it was found to be biased with the intention of awarding contracts to the scheme persons, with the intention of controlling competition.

The single source agency was chosen with the intention of awarding contracts to the proposed organizations without the prospect of reaching more people with environmental awareness programs, the report said.

 In addition to this, in a letter written by Mahadeva to the Member Secretary of the Pollution Control Board on August 16, a proposal for readjustment in the budget of ₹24.60 crore has also been submitted to the board meeting. It has been suggested to provide the copies of the power transfer order received from the government for readjustment to these account headings.

 Background of the case

 A meeting of the 'Single Source Committee' chaired by Board CHAIRMAN Shant Thimmaiah agreed to award the contract to specific agencies in violation of the Karnataka Transparency in Public Procurement Act-1999 (KTPP) to carry out awareness programs worth ₹17.85 crore. Suri Payala, who was the member secretary of the board, had written a letter to the government saying that all this is a violation of the KTPP Act and action should be taken in this regard. The Principal Secretary of the Department of Environment and Biodiversity had written to him on July 3 and given all the information approved in the 'Single Source Committee' meeting. Based on this, the government formed an inquiry committee.

Bengaluru: Telecom Employees' Housing Co-operative Society has sold the 'CA site' which was being used by the Telecom layout Residents' Welfare Association for 20 years.

 Confusion has arisen after 20 years regarding the two sites of 'civic amenities' between the Vijayanagar 2nd Phase Telecom layout Residents' Welfare Association and the Telecom Employees' Housing Cooperative Association. The members of the welfare association have complained to the regulator of the cooperative societies and the Lokayukta that action should be taken against the irregularities.

 The regulator of cooperative societies has also issued a notice on June 22 to explain the illegal sale of plots 5 and 6 of the Vijayanagara Telecom layout in Hosahalli ward with an area of about seven thousand square feet.


Telecom Layout: CASE OF SELF-MOTIVATION FILED BY COURT

Bengaluru: The Karnataka Land Grab Prohibition Special Court has registered a case on SUO MOTU regarding the sale of land (CA) by the Telecom Employees' House Cooperative Society in the Vijayanagar Telecom Layout.

On the basis of a report published in 'Prajavani' on August 12 under the title 'Telecom development: sale of CA land', the court registered a case and issued notices to Bengaluru North Tehsildar, BDA Commissioner and BBMP Chief Commissioner.

5th and 6th plots of about seven thousand square feet area in Vijayanagara Telecom Layout in Hosahalli ward were illegally sold to Anil Tilak for ₹2.32 crore. This C.A. Regarding the encroachment of land, the court directed the three officers to submit a detailed report of all the information including area, name of encroached persons, detailed sketch, approved plan by October 12.


 Telecom Employees Co-operative Housing Society allotted 370 plots in Vijayanagar Telecom layout in 1995-96 as per BDA-1975 Act. Civil amenities or buildings were not constructed. In this background permission was given to construct a building in 2002-03 to the Residents Welfare Development Association at sites 5 and 6. According to the residents, building construction and office of the association are there and civic activities have been going on there till now.

All office bearers of the society participated in cultural and other programs. The State Election Commission also sets up a polling station here during elections in the residents welfare association building. Housing society has also promised to build a community building at this place. But so far it has not been fulfilled. Now the plan itself has been modified and plot 6 has been sold to Anil Tilak for ₹2.32 crore. The residents have complained that they have cheated the residents of the barangay and issued these vouchers.

 Petition for cancellation of deed

 The office-bearers of the Telecom Employees' Housing Co-operative Society have sold the land that should have been used by the citizens by distorting the original plan approved by the BDA. A complaint has been made to the regulator of cooperative societies to cancel this purchase deed and leave this space, which has been used by the citizens for 20 years, to the activities of the welfare association. The Lokayukta has also been requested to investigate this illegality. Chandranath, of Telecom layout Residents' Welfare Association, appealed that the government should intervene and provide justice to the citizens.

 In Sir M.Vishveshvaraiah layout 6th block Plan, BDA has clearly mentioned in the zoning plan that a parks will be constructed at Civic Facility Plots No. 6 and 18. However, apart from putting up the gate as 'BDA', no other work has been done here. Dead bodies are buried here. A memorial is also being built on them. Some of the surrounding houses are scared by this. Those who have plots are reluctant to build houses.

 Of course no one would venture to build a house in front of or next to a graveyard. Citizens who were happy to get the BDA site after many years, when they went to the place to build a house, the 'new monuments' raised their heads in front of them caused a tremor.

 We were happy that we got a plot opposite the park. However, a few years ago when the house was about to be built, there was a graveyard there. The corpses were being buried afresh. BDA engineers were asked about this and they replied very harsh. If you go to complain, the local engineers will not take it. The family does not agree to build a house in front of the graveyard. The children are scared,' said an owner of the plot who did not want to reveal his name.

 We were happy that the park would be built, but we were scared by the words of the BDA engineers. They are saying that they will save the cemetery itself due to the insistence of the locals. No one wants to buy this property, let's sell it and buy it elsewhere for the same price. Some are asking for very low prices,' lamented another owner of the site.

Gomala: No compensation...

 It is mentioned as 'Park 6' in the 6th block of Vishveshvaraiah layout 6th block. A fence and gate have been installed by the engineering department earlier to develop it as a park. Plots are allocated accordingly. The owners of the surrounding plots have complained a lot that dead bodies are being buried here. A joint survey has been conducted in this regard and its file is pending with ALAO. According to the land acquisition documents, this land is Gomal and no compensation has been given, senior BDA officials informed.

 Locals asked, we left...

 As local villagers said 'We have been performing funerals here for 30-35 years. They insisted that we should be allowed here'. Thus, the BDA has left the area as a graveyard. The same will be developed and allowed to bury dead bodies. This land has been handed over to the horticulture department of BDA and they will develop it for the cemetery,” said BDA Assistant Executive Engineer Prabhulingaiah.

 "We have not been handed over this space by the engineering department," said officials of the horticulture department.

 It should be shown on the PLAN itself...

 Even if the previous cemetery should be continued, it should be shown on the PLAN. "It cannot be said that we will save and develop the cemetery by giving in to the insistence of the locals, without showing it on the PLAN," said senior BDA officials.

 4.12.1 and 4.12.2 of the BDA Bylaws mention the use of parks and open spaces. Can be used for grounds, stadiums, gardens, swimming pools, cemeteries. However, he said that it is clear that it should be mentioned in the PLAN.

Develop as a PARK...

 Some villagers are burying dead bodies claiming that it is a graveyard. Once the BDA is acquired, it should be mentioned in the PLAN itself that it will be retained. Now what was in the past is now causing trouble to the landlords. Children and women are scared. If BDA is so interested, let them make space for the 'cemetery' elsewhere. More than 12,000 acres of land in Bangalore city have been regularized on the basis of cultivation. But the applications submitted in Form 50/53 have to be sanctioned by the Committee of Local MLAs. However, they cannot be sanctioned as per the Act. He said that the applications have not been rejected.

 According to the law, land cannot be allotted for cultivation within a distance of 18 km around the BBMP border. Oneness cannot be done here. As applications for such lands are pending before the committee, real estate in the area has taken off. Huge buildings have been built. He asked whether he will clear all of them.

 According to Koliwada's report, the encroachment of the city's lakes exceeds four thousand acres. Most of the lakes come under the revenue department. But, can you believe that there is only 269 acres encroachment? He opined that if the revenue minister gets to know the reality, he too will calm down.

Bengaluru: A TASK FORCE of separate officers has been formed in eight zones of BBMP to carry out evacuation operations of buildings constructed in VIOLATION OF THE PLAN within the city limits.

 A task force has been formed under the chairmanship of the Zonal Commissioner, the members of which will meet every month and carry out the clearance operation. A report of this operation will also be given every month. Chief Commissioner has also ordered to suspend the officers who do not take action against the illegality and take disciplinary action.

 On July 31, Chief Commissioner Tushar Girinath issued an order to 'constitute a task force to prevent violation of building sanction plans, construction of unauthorized buildings, and to clear the building or its parts constructed in violation'.

 Officers have also been given the responsibility to enforce KMC Act Section 321 and BBMP Act 2020 Section 248 and 356. Guidelines for disciplinary action against authorities failing to comply with this have been outlined in the order.

 After sanctioning the plan for construction of the building, the 'Plinth Line Marking' of the building must be compulsorily obtained by the concerned officer. Later, the responsibility of checking the construction from time to time as well as the plan is also prescribed.

Time Limit: The order also contains a 'flowchart' of the process of taking action/who should carry out the responsibilities for the eviction of the encroached building. Responsibilities and days are fixed for Junior Engineer, Assistant Engineer, Assistant Executive Engineer, Executive Engineer, Assistant Director of Town Planning. A total of 117 days have been allotted for submitting the report from the issuance of the first notice to the completion of the eviction operation.

 Work force activity

Mandatory meeting to be held every month, review of report given by Ward Engineer regarding unauthorized construction and PLAN violations. Action should be taken to look into citizens' complaints and issue notices. Check the status of issued notices. Notifying concerned authorities about action to be taken against buildings. As soon as the notice is given, it should be ensured that the construction of the building is stopped. Violation of the PLAN, submission of estimated list for clearance of illegally constructed parts, coordination with authorities and operation should be carried out. If there is a restraining order from the courts, steps should be taken to clear it promptly with appropriate documents. The Zonal Joint Director of Town Planning should submit a report on the case of PLAN VIOLATIONS and the steps taken to rectify the same to the Additional Director of Urban Planning every month.
