Lake Buffer zone reduce: Governor returns Bill to Government

The Karnataka Lake Conservation and Development Authority (Amendment) Bill, 2025, which the state government had introduced in the legislature despite opposition from the opposition parties to reduce the lake buffer zone and which had been approved, was sent back to the government on September 15, 2025, by the Governor after seeking some clarifications.

SUBJECT: The Karnataka Tank Conservation & Development Authority (Amendment)-Bill, 2025-
FILE NO. GS 109 GOB 2025 -DRAL 4 9 SHASANA 2 0 2 5
Hon'ble Governor has ordered as below in the file;
"Perused the file;
a. State Government has proposed to amend the section12 of the Karnataka Tank Conservation & Development Authority Act, 2014 to introduce area-wise buffer zones for water bodies and permit for construction of certain public utility activities such as roads, bridges, electrical line, water supply line, Under Ground Drainage (UGD) line, Jack well or pump house or Sewage Treatment Plant (STP), Intermediate Sewage Pumping Station (ISPS), Wet well, Aqueduct and allied works with prior approval of the authority.
b. My office has received objection from the Bengaluru TownHall Association with a request to not assent the Karnataka Tank Conservation & Development Authority (Amendment) Bill, 2025. Some of the concerns are as fallows;
• as per the expert's opinion, the present lake buffer zone of 30 Meter itself is insufficient, and the real requirement is nearly 300 Meter to achieve ecosystem balance. If anything, to do, the buffer zone should be increased not decreased.
• State Government has not consulted the expert committee and also not consulted the public about the implication of this amendment.
• It is in violative of the Constitution and settled Law and is harmful for every citizen, affects the citizens right to water security and a healthy environment.
c. Further, they have also given detailed memorandum about the constitutional violations in part I, central laws and guidelines in part Ill and adverse impact on water security issues in part-IV.
d. Hence, it is necessary to get the clarifications from the State Government about the issues raised by the TownHall association and also to know that whether this amendment has really adverse effect or not.
e. Hence, return the file to State Government to re-submit the file along with proper clarifications in this regard.

ಎ. ರಾಜ್ಯ ಸರ್ಕಾರವು ಕರ್ನಾಟಕ ಕೆರೆ ಸಂರಕ್ಷಣೆ ಮತ್ತು ಅಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರ ಕಾಯ್ದೆ, 2014 ರ ಸೆಕ್ಷನ್ 12 ಅನ್ನು ತಿದ್ದುಪಡಿ ಮಾಡಲು ಪ್ರಸ್ತಾಪಿಸಿದೆ, ಇದರಿಂದಾಗಿ ಜಲಮೂಲಗಳಿಗೆ ಪ್ರದೇಶವಾರು ಬಫರ್ ವಲಯಗಳನ್ನು ಪರಿಚಯಿಸಲು ಮತ್ತು ರಸ್ತೆಗಳು, ಸೇತುವೆಗಳು, ವಿದ್ಯುತ್ ಮಾರ್ಗ, ನೀರು ಸರಬರಾಜು ಮಾರ್ಗ, ನೆಲದಡಿಯ ಒಳಚರಂಡಿ (ಯುಜಿಡಿ) ಮಾರ್ಗ, ಜಾಕ್ ವೆಲ್ ಅಥವಾ ಪಂಪ್ ಹೌಸ್ ಅಥವಾ ಒಳಚರಂಡಿ ಸಂಸ್ಕರಣಾ ಘಟಕ (ಎಸ್ಟಿಪಿ), ಮಧ್ಯಂತರ ಒಳಚರಂಡಿ ಪಂಪಿಂಗ್ ಸ್ಟೇಷನ್ (ಐಎಸ್ಪಿಎಸ್), ಒದ್ದೆಯಾದ ಬಾವಿ, ಅಕ್ವೆಡಕ್ಟ್ ಮತ್ತು ಸಂಬಂಧಿತ ಕೆಲಸಗಳಂತಹ ಕೆಲವು ಸಾರ್ವಜನಿಕ ಉಪಯುಕ್ತ ಚಟುವಟಿಕೆಗಳ ನಿರ್ಮಾಣಕ್ಕೆ ಪ್ರಾಧಿಕಾರದ ಪೂರ್ವಾನುಮತಿಯೊಂದಿಗೆ ಅನುಮತಿ ನೀಡಲಾಗಿದೆ.
ಬಿ. ಕರ್ನಾಟಕ ಕೆರೆ ಸಂರಕ್ಷಣೆ ಮತ್ತು ಅಭಿವೃದ್ಧಿ ಪ್ರಾಧಿಕಾರ (ತಿದ್ದುಪಡಿ) ಮಸೂದೆ, 2025 ಕ್ಕೆ ಒಪ್ಪಿಗೆ ನೀಡದಿರಲು ಬೆಂಗಳೂರು ಟೌನ್ಹಾಲ್ ಅಸೋಸಿಯೇಷನ್ನಿಂದ ನನ್ನ ಕಚೇರಿಗೆ ಆಕ್ಷೇಪಣೆ ಬಂದಿದೆ. ಕೆಲವು ಕಳವಳಗಳು ಬಂದಿವೆ;
• ತಜ್ಞರ ಅಭಿಪ್ರಾಯದ ಪ್ರಕಾರ, ಪ್ರಸ್ತುತ 30 ಮೀಟರ್ನ ಕೆರೆ ಬಫರ್ ವಲಯವು ಸಾಕಷ್ಟಿಲ್ಲ, ಮತ್ತು ಪರಿಸರ ವ್ಯವಸ್ಥೆಯ ಸಮತೋಲನವನ್ನು ಸಾಧಿಸಲು ನಿಜವಾದ ಅವಶ್ಯಕತೆ ಸುಮಾರು 300 ಮೀಟರ್ ಆಗಿದೆ. ಏನಾದರೂ ಮಾಡಬೇಕಾದರೆ, ಬಫರ್ ವಲಯವನ್ನು ಕಡಿಮೆ ಮಾಡದೆ ಹೆಚ್ಚಿಸಬೇಕು.
• ರಾಜ್ಯ ಸರ್ಕಾರವು ತಜ್ಞರ ಸಮಿತಿಯೊಂದಿಗೆ ಸಮಾಲೋಚಿಸಿಲ್ಲ ಮತ್ತು ಈ ತಿದ್ದುಪಡಿಯ ಪರಿಣಾಮದ ಬಗ್ಗೆ ಸಾರ್ವಜನಿಕರೊಂದಿಗೆ ಸಮಾಲೋಚಿಸಿಲ್ಲ.
• ಇದು ಸಂವಿಧಾನ ಮತ್ತು ಸ್ಥಾಪಿತ ಕಾನೂನನ್ನು ಉಲ್ಲಂಘಿಸುತ್ತದೆ ಮತ್ತು ಪ್ರತಿಯೊಬ್ಬ ನಾಗರಿಕರಿಗೂ ಹಾನಿಕಾರಕವಾಗಿದೆ, ನೀರಿನ ಸುರಕ್ಷತೆಯ ನಾಗರಿಕರ ಹಕ್ಕು ಮತ್ತು ಆರೋಗ್ಯಕರ ಪರಿಸರದ ಮೇಲೆ ಪರಿಣಾಮ ಬೀರುತ್ತದೆ.
ಸಿ. ಇದಲ್ಲದೆ, ಭಾಗ I ರಲ್ಲಿ ಸಾಂವಿಧಾನಿಕ ಉಲ್ಲಂಘನೆಗಳು, ಕೇಂದ್ರ ಕಾನೂನುಗಳು ಮತ್ತು ಮಾರ್ಗಸೂಚಿಗಳು ಭಾಗ IV ರಲ್ಲಿ ನೀರಿನ ಭದ್ರತಾ ಸಮಸ್ಯೆಗಳ ಮೇಲೆ ಅನಾರೋಗ್ಯಕರ ಮತ್ತು ಪ್ರತಿಕೂಲ ಪರಿಣಾಮದ ಬಗ್ಗೆ ಅವರು ವಿವರವಾದ ಜ್ಞಾಪಕ ಪತ್ರವನ್ನು ನೀಡಿದ್ದಾರೆ.
ಡಿ. ಆದ್ದರಿಂದ, ಟೌನ್ಹಾಲ್ ಸಂಘವು ಎತ್ತಿರುವ ಸಮಸ್ಯೆಗಳ ಬಗ್ಗೆ ರಾಜ್ಯ ಸರ್ಕಾರದಿಂದ ಸ್ಪಷ್ಟೀಕರಣಗಳನ್ನು ಪಡೆಯುವುದು ಮತ್ತು ಈ ತಿದ್ದುಪಡಿ ನಿಜವಾಗಿಯೂ ಪ್ರತಿಕೂಲ ಪರಿಣಾಮ ಬೀರುತ್ತದೆಯೇ ಅಥವಾ ಇಲ್ಲವೇ ಎಂಬುದನ್ನು ತಿಳಿದುಕೊಳ್ಳುವುದು ಅವಶ್ಯಕ.
ಇ. ಆದ್ದರಿಂದ, ಈ ವಿಷಯದಲ್ಲಿ ಸರಿಯಾದ ಸ್ಪಷ್ಟೀಕರಣಗಳೊಂದಿಗೆ ಫೈಲ್ ಅನ್ನು ಮರು ಸಲ್ಲಿಸಲು ಫೈಲ್ ಅನ್ನು ರಾಜ್ಯ ಸರ್ಕಾರಕ್ಕೆ ಹಿಂತಿರುಗಿಸಿ.
