Urban Development Department proposes to GOVERNMENT amend the KMC Act

OC not required for THREE Floors Buildings

Bengaluru: The Urban Development Department has decided to exempt three-storey buildings on 1200 sq ft plots in the state from obtaining Occupancy Certificate (OC).

In this regard, it has been decided in a meeting chaired by Additional Chief Secretary of the Urban Development Department, Tushar Girinath, to submit a proposal to the government to amend the Greater Bangalore Administration Act (GBA)- 2024, Karnataka Municipal Corporations Act 1976 (KMC Act), and the Model Building By-laws of the Rural Development and Panchayat Raj Department.

Buildings up to ground floor + two floors or stilts + three floors on a plot of 1200 sq ft will be exempted from obtaining Occupancy Certificate.

Section 241(7) of the GBA-2024 Act states that the government may issue a notification to exempt OCs. However, this provision is not available in the BBMP Act-2020, KMC-1976 Act, and the Karnataka Municipal Corporation Act 1964. 

In a meeting held under the chairmanship of the Chief Minister with the Deputy Chief Minister, Parliamentary Affairs Minister, Food, Industries, Energy, Revenue, Urban Development, and Municipal Administration Ministers, it was felt that there should be parallel provisions in all the acts. Therefore, it was decided in the meeting headed by the Additional Chief Secretary of the Urban Development Department to formulate rules to exempt OCs and submit a proposal to the government to amend the acts.

Officials of the Urban Development Department, BBMP, BESCOM, Municipal Administration, Energy, and Panchayat Raj Commissionerate were present in the meeting.

ಬೆಂಗಳೂರು: ರಾಜ್ಯದಲ್ಲಿ 1200 ಚದರಡಿ ನಿವೇಶನಗಳಲ್ಲಿನ ಮೂರು ಅಂತಸ್ತಿನ ಕಟ್ಟಡಗಳಿಗೆ ಸ್ವಾಧೀನಾನುಭವ ಪ್ರಮಾಣ ಪತ್ರ (ಒಸಿ) ಪಡೆಯುವುದಕ್ಕೆ ವಿನಾಯಿತಿ ನೀಡಲು ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆ ತೀರ್ಮಾನಿಸಿದೆ.

ಇದಕ್ಕೆ ಸಂಬಂಧಿಸಿದಂತೆ, ಗ್ರೇಟರ್‌ ಬೆಂಗಳೂರು ಆಡಳಿತ ಕಾಯ್ದೆ (ಜಿಬಿಎ)– 2024, ಕರ್ನಾಟಕ ಮಹಾನಗರ ಪಾಲಿಕೆಗಳ ಕಾಯ್ದೆ 1976 (ಕೆಎಂಸಿ ಕಾಯ್ದೆ), ಗ್ರಾಮೀಣಾಭಿವೃದ್ಧಿ ಮತ್ತು ಪಂಚಾಯತ್‌ ರಾಜ್‌ ಇಲಾಖೆಯ ಮಾದರಿ ಕಟ್ಟಡ ಬೈ–ಲಾಗಳನ್ನು ತಿದ್ದುಪಡಿ ಮಾಡಲು ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವ ಸಲ್ಲಿಸಲು ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆಯ ಹೆಚ್ಚುವರಿ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ ತುಷಾರ್ ಗಿರಿನಾಥ್‌ ನೇತೃತ್ವದಲ್ಲಿ ನಡೆದ ಸಭೆಯಲ್ಲಿ ನಿರ್ಧರಿಸಲಾಗಿದೆ.

1200 ಚದರಡಿ ವಿಸ್ತೀರ್ಣದ ನಿವೇಶನದಲ್ಲಿ ನೆಲ ಅಂತಸ್ತು + ಎರಡು ಅಂತಸ್ತು ಅಥವಾ ಸ್ಟಿಲ್ಟ್‌ + ಮೂರು ಅಂತಸ್ತಿನವರೆಗಿನ ಕಟ್ಟಡಗಳಿಗೆ ಸ್ವಾಧೀನಾನುಭವ ಪ್ರಮಾಣ ಪತ್ರ ಪಡೆಯುವುದರಿಂದ ವಿನಾಯಿತಿ ನೀಡಲಾಗುತ್ತದೆ.

ಜಿಬಿಎ–2024 ಕಾಯ್ದೆಯಲ್ಲಿ ಒಸಿಗೆ ವಿನಾಯಿತಿ ನೀಡಲು ಸರ್ಕಾರ ಅಧಿಸೂಚನೆ ಹೊರಡಿಸಬಹುದು ಎಂದು ಸೆಕ್ಷನ್‌ 241(7)ರಲ್ಲಿ ಹೇಳಲಾಗಿದೆ. ಆದರೆ, ಬಿಬಿಎಂಪಿ ಕಾಯ್ದೆ–2020, ಕೆಎಂಸಿ– 1976 ಕಾಯ್ದೆ, ಕರ್ನಾಟಕ ಪುರಸಭೆ ಕಾಯ್ದೆ 1964ರಲ್ಲಿ ಈ ಅವಕಾಶ ಇರುವುದಿಲ್ಲ.  

ಮುಖ್ಯಮಂತ್ರಿಯವರ ನೇತೃತ್ವದಲ್ಲಿ ಉಪಮುಖ್ಯಮಂತ್ರಿ, ಸಂಸದೀಯ ವ್ಯವಹಾರಗಳ ಸಚಿವರು, ಆಹಾರ, ಕೈಗಾರಿಕೆ, ಇಂಧನ, ಕಂದಾಯ, ನಗರಾಭಿವೃದ್ಧಿ, ಪೌರಾಡಳಿತ ಸಚಿವರೊಂದಿಗೆ ನಡೆದ ಸಭೆಯಲ್ಲಿ ಎಲ್ಲ ಕಾಯ್ದೆಗಳಲ್ಲೂ ಸಮಾನಾಂತರ ಅವಕಾಶಗಳು ಇರಬೇಕು ಎಂಬ ಅಭಿಪ್ರಾಯ ವ್ಯಕ್ತವಾಗಿದೆ. ಆದ್ದರಿಂದ, ಒಸಿಗೆ ವಿನಾಯಿತಿ ನೀಡಲು ನಿಯಮಗಳನ್ನು ರಚಿಸಿ, ಕಾಯ್ದೆಗಳಿಗೆ ತಿದ್ದುಪಡಿ ತರರಲು ಸರ್ಕಾರಕ್ಕೆ ಪ್ರಸ್ತಾವ ಸಲ್ಲಿಸಲು ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆಯ ಹೆಚ್ಚುವರಿ ಮುಖ್ಯ ಕಾರ್ಯದರ್ಶಿ ನೇತೃತ್ವದ ಸಭೆಯಲ್ಲಿ ನಿರ್ಧರಿಸಲಾಗಿದೆ.

ನಗರಾಭಿವೃದ್ಧಿ ಇಲಾಖೆ, ಬಿಬಿಎಂಪಿ, ಬೆಸ್ಕಾಂ, ಪೌರಾಡಳಿತ, ಇಂಧನ, ಪಂಚಾಯತ್‌ ರಾಜ್‌ ಆಯುಕ್ತಾಲಯದ ಅಧಿಕಾರಿಗಳು ಸಭೆಯಲ್ಲಿ ಉಪಸ್ಥಿತರಿದ್ದರು.
