Bengaluru: Hundreds of tenders called during the Bruhat Bengaluru Mahanagara Palike (BBMP) period have not been finalized, and more than ₹50 crore Earnest money Deposit (EMD) paid by contractors has been ‘frozen’ in banks for four months.

BBMP ceased to exist and the Greater Bengaluru Authority (GBA) and five CITY corporations were formed on September 2. Despite knowing that BBMP would cease to exist, the authorities had invited tenders for various works till September 2.

After the GBA came into existence, the process of all tenders has been stopped. The process of thousands of tenders invited in August and September has not been completed. Thus, more than ₹50 crore, which was paid as EMD by dozens of contractors, has been left in banks. 

Neither BBMP nor banks pay interest on the EMD amount paid by contractors. The EMD amount has been paid to banks through e-procurement software. This amount remains in the banks.

The process of tenders invited since July when BBMP was in power is still ‘frozen’. Although work orders have been issued for hundreds of works, they have not yet been transferred to the municipal corporation where they should fall. The EMD of the contractors who submitted bids for these works has not been returned to them.

In the last two months, tenders were called for various works in a hurry. Hundreds of contractors have paid EMD and submitted bids. Since the process of such tenders has also been ‘frozen’, the EMD amount remains pending in banks.

Request to return EMD

‘When BBMP was in existence, many tenders were invited, but the tender process has not yet been completed by Greater Bengaluru or the municipal corporations. Contractors have paid hundreds of crores as EMD, which remains in the bank. The bank has benefited since no interest is paid on EMD. GBA-municipal corporations have nothing to lose. However, a situation has arisen where contractors are losing their money. Therefore, the tender processes should be completed immediately and the EMD should be returned. Otherwise, all the tenders should be cancelled and the EMD should be returned,’ said BBMP Contractors Association President G.M. Nandakumar.

‘Although a request was submitted to the GBA Chief Commissioner on October 4 in this regard, it was of no use. Now, since the e-governance has instructed to forfeit the EMD amount after three months, all the contractors are worried. They demanded that the EMD should be returned immediately.’

Order for forfeiture of EMD

The EMD amount submitted in relation to tenders/auctions in e-procurement software version 1.0 should be refunded within three months. Otherwise, the amount should be forfeited and deposited in the government’s consolidated fund, the e-Governance Department has issued a circular on October 24.

Karnataka Public Procurement Portal (KPPP) version 1.0 has been deactivated from October 14. Therefore, the pending tenders/auctions in it should be completed within three months. Otherwise, the Chief Executive Officer of e-Governance has directed that all EMD should be forfeited and deposited in the government’s consolidated fund by the respective departments.

ಬೆಂಗಳೂರು: ಬೃಹತ್‌ ಬೆಂಗಳೂರು ಮಹಾನಗರ ಪಾಲಿಕೆ (ಬಿಬಿಎಂಪಿ) ಅವಧಿಯಲ್ಲಿ ಕರೆಯಲಾಗಿದ್ದ ನೂರಾರು ಟೆಂಡರ್‌ಗಳು ಅಂತಿಮಗೊಳ್ಳದೆ, ನಾಲ್ಕು ತಿಂಗಳಿಂದ  ಗುತ್ತಿಗೆದಾರರು ಪಾವತಿಸಿರುವ ₹50 ಕೋಟಿಗೂ ಹೆಚ್ಚು ಮುಂಗಡ ಹಣ (ಇಎಂಡಿ) ಬ್ಯಾಂಕ್‌ಗಳಲ್ಲೇ ‘ಫ್ರೀಜ್‌’ ಆಗಿದೆ.

ಬಿಬಿಎಂಪಿ ಅಸ್ತಿತ್ವ ಕಳೆದುಕೊಂಡು ಗ್ರೇಟರ್‌ ಬೆಂಗಳೂರು ಪ್ರಾಧಿಕಾರ (ಜಿಬಿಎ) ಹಾಗೂ ಐದು ನಗರ ಪಾಲಿಕೆಗಳು ಸೆಪ್ಟೆಂಬರ್‌ 2ರಂದು ರಚನೆಯಾದವು. ಬಿಬಿಎಂಪಿ ಅಸ್ತಿತ್ವ ಕಳೆದುಕೊಳ್ಳುತ್ತದೆ ಎಂಬ ಅರಿವಿದ್ದರೂ ಅಧಿಕಾರಿಗಳು ಸೆ.2ರವರೆಗೂ ವಿವಿಧ ಕಾಮಗಾರಿಗಳಿಗೆ ಟೆಂಡರ್‌ಗಳನ್ನು ಆಹ್ವಾನಿಸಿದ್ದರು.

ಜಿಬಿಎ ಅಸ್ತಿತ್ವಕ್ಕೆ ಬಂದ ನಂತರ ಎಲ್ಲ ಟೆಂಡರ್‌ಗಳ ಪ್ರಕ್ರಿಯೆ ಸ್ಥಗಿತಗೊಂಡಿವೆ. ಆಗಸ್ಟ್‌ ಮತ್ತು ಸೆಪ್ಟೆಂಬರ್‌ನಲ್ಲಿ ಆಹ್ವಾನಿಸಲಾಗಿದ್ದ ಸಾವಿರಾರು ಟೆಂಡರ್‌ಗಳ ಪ್ರಕ್ರಿಯೆ ಪೂರ್ಣ ಮುಗಿದಿಲ್ಲ.  ಹೀಗಾಗಿ, ಒಂದು ಟೆಂಡರ್‌ ಮೊತ್ತದ ಶೇ 1ರಷ್ಟನ್ನು ಇಎಂಡಿಯಾಗಿ ಹತ್ತಾರು ಗುತ್ತಿಗೆದಾರರು ಪಾವತಿಸಿದ್ದ ₹50ಕ್ಕೂ ಹೆಚ್ಚು ಕೋಟಿ ಬ್ಯಾಂಕ್‌ಗಳಲ್ಲಿಯೇ ಉಳಿಸಿದೆ. 

ಗುತ್ತಿಗೆದಾರರು ಪಾವತಿಸಿರುವ ಇಎಂಡಿ ಮೊತ್ತಕ್ಕೆ ಬಿಬಿಎಂಪಿಯಾಗಲಿ, ಬ್ಯಾಂಕ್‌ ಆಗಲಿ ಬಡ್ಡಿ ನೀಡುವುದಿಲ್ಲ. ಇಎಂಡಿ ಮೊತ್ತವನ್ನು ಇ–ಸಂಗ್ರಹಣಾ (ಇ–ಪ್ರೊಕ್ಯೂರ್‌ಮೆಂಟ್) ತಂತ್ರಾಂಶದ ಮೂಲಕ ಬ್ಯಾಂಕ್‌ಗಳಿಗೆ ಪಾವತಿಸಲಾಗಿದೆ. ಈ ಮೊತ್ತ ಬ್ಯಾಂಕ್‌ಗಳಲ್ಲೇ ಉಳಿದಿದೆ.

ಬಿಬಿಎಂಪಿಯಿದ್ದಾಗ ಜುಲೈನಿಂದ ಆಹ್ವಾನಿಸಲಾಗಿದ್ದ ಟೆಂಡರ್‌ಗಳ ಪ್ರಕ್ರಿಯೆ ಇನ್ನೂ ‘ಫ್ರೀಜ್‌’ನಲ್ಲೇ ಇದೆ. ನೂರಾರು ಕಾಮಗಾರಿಗಳಿಗೆ ಕಾರ್ಯಾದೇಶ ನೀಡಲಾಗಿದ್ದರೂ ಅದು ಯಾವ ನಗರ ಪಾಲಿಕೆ ವ್ಯಾಪ್ತಿಗೆ ಸೇರಬೇಕೋ ಅಲ್ಲಿಗೆ ಅವುಗಳನ್ನು ಇನ್ನೂ ವರ್ಗಾಯಿಸಿಲ್ಲ. ಈ ಕಾಮಗಾರಿಗಳಿಗೆ ಬಿಡ್‌ ಸಲ್ಲಿಸಿದ್ದ ಗುತ್ತಿಗೆದಾರರ ಇಎಂಪಿಯನ್ನೂ ಅವರಿಗೆ ವಾಪಸ್‌ ನೀಡಿಲ್ಲ.

ಇನ್ನು ಕೊನೆಯ ಎರಡು ತಿಂಗಳಲ್ಲಿ ತರಾತುರಿಯಲ್ಲಿ ನಾನಾ ಕಾಮಗಾರಿಗಳಿಗೆ ಟೆಂಡರ್ ಕರೆಯಲಾಗಿತ್ತು. ನೂರಾರು ಗುತ್ತಿಗೆದಾರರು ಇಎಂಡಿ ಪಾವತಿಸಿ ಬಿಡ್‌ ಸಲ್ಲಿಸಿದ್ದಾರೆ. ಇಂತಹ ಟೆಂಡರ್‌ಗಳ ಪ್ರಕ್ರಿಯೆಯೂ ಫ್ರೀಜ್‌’ ಆಗಿರುವುದರಿಂದ ಇಎಂಡಿ ಮೊತ್ತ ಬ್ಯಾಂಕ್‌ಗಳಲ್ಲೇ ಬಾಕಿ ಉಳಿದಿದೆ.

ಇಎಂಡಿ ವಾಪಸ್‌ ನೀಡಲು ಮನವಿ

‘ಬಿಬಿಎಂಪಿ ಅಸ್ತಿತ್ವದಲ್ಲಿದ್ದಾಗ ಹಲವು ಟೆಂಡರ್‌ಗಳನ್ನು ಆಹ್ವಾಸಿದ್ದು, ಟೆಂಡರ್‌ ಪ್ರಕ್ರಿಯೆಯನ್ನು ಗ್ರೇಟರ್‌ ಬೆಂಗಳೂರು ಅಥವಾ ನಗರ ಪಾಲಿಕೆಗಳು ಇನ್ನೂ ಪೂರ್ಣಗೊಳಿಸಿಲ್ಲ. ಗುತ್ತಿಗೆದಾರರು ನೂರಾರು ಕೋಟಿಯನ್ನು ಇಎಂಡಿಯಾಗಿ ಪಾವತಿಸಿದ್ದು, ಅದು ಬ್ಯಾಂಕ್‌ನಲ್ಲೇ ಉಳಿದಿದೆ.  ಇಎಂಡಿಗೆ ಯಾವುದೇ ಬಡ್ಡಿ ನೀಡದಿರುವುದರಿಂದ ಬ್ಯಾಂಕ್‌ಗೆ ಲಾಭವಾಗಿದೆ. ಜಿಬಿಎ– ನಗರ ಪಾಲಿಕೆಗಳು ಕಳೆದುಕೊಳ್ಳುವುದೇನೂ ಇಲ್ಲ. ಆದರೆ, ಗುತ್ತಿಗೆದಾರರು ತಮ್ಮ ಹಣವನ್ನು ಕಳೆದುಕೊಳ್ಳುವಂತಹ ಸ್ಥಿತಿ ನಿರ್ಮಾಣವಾಗಿದೆ. ಹೀಗಾಗಿ, ಕೂಡಲೇ ಟೆಂಡರ್‌ ಪ್ರಕ್ರಿಯೆಗಳನ್ನು ಮುಗಿಸಿ ಇಎಂಡಿ ಹಿಂದಿರುಗಿಬೇಕು. ಇಲ್ಲವೇ, ಎಲ್ಲ ಟೆಂಡರ್‌ಗಳನ್ನು ರದ್ದು ಮಾಡಿ ಇಎಂಡಿ ವಾಪಸ್‌ ನೀಡಬೇಕು’ ಎಂದು ಬಿಬಿಎಂಪಿ ಗುತ್ತಿಗೆದಾರರ ಸಂಘದ ಅಧ್ಯಕ್ಷ ಜಿ.ಎಂ. ನಂದಕುಮಾರ್‌ ತಿಳಿಸಿದರು.

‘ಈ ಬಗ್ಗೆ ಜಿಬಿಎ ಮುಖ್ಯ ಆಯುಕ್ತರಿಗೆ ಅಕ್ಟೋಬರ್ 4ರಂದು ಮನವಿ ಸಲ್ಲಿಸಿದ್ದರೂ ಪ್ರಯೋಜನವಾಗಿಲ್ಲ. ಇದೀಗ, ಇ–ಆಡಳಿತದವರು ಮೂರು ತಿಂಗಳ ನಂತರದ ಇಎಂಡಿ ಮೊತ್ತವನ್ನು ಮುಟ್ಟುಗೋಲು ಹಾಕಿಕೊಳ್ಳುವಂತೆ ಸೂಚಿಸಿರುವುದರಿಂದ ಗುತ್ತಿಗೆದಾರರೆಲ್ಲ ಆತಂಕಗೊಂಡಿದ್ದಾರೆ. ಕೂಡಲೇ ಇಎಂಡಿ ವಾಪಸ್‌ ಮಾಡಬೇಕು’ ಎಂದು ಆಗ್ರಹಿಸಿದರು.

 

ಇಎಂಡಿ ಮುಟ್ಟುಗೋಲಿಗೆ ಆದೇಶ

ಇ–ಸಂಗ್ರಹಣಾ ತಂತ್ರಾಂಶ 1.0 ಆವೃತ್ತಿಯಲ್ಲಿ ಟೆಂಡರ್/ ಹರಾಜುಗಳಿಗೆ ಸಂಬಂಧಿಸಿದಂತೆ ಸಲ್ಲಿಕೆಯಾಗಿರುವ ಇಎಂಡಿ ಮೊತ್ತವನ್ನು ಮೂರು ತಿಂಗಳಲ್ಲಿ ಮರುಪಾವತಿಸಬೇಕು. ಇಲ್ಲದಿದ್ದರೆ ಆ ಮೊತ್ತವನ್ನು ಮುಟ್ಟುಗೋಲು ಹಾಕಿಕೊಂಡು, ಸರ್ಕಾರದ ಸಂಚಿತ ನಿಧಿಗೆ ಜಮೆ ಮಾಡಬೇಕು ಎಂದು ಇ–ಆಡಳಿತ ಅ.24ರಂದು ಸುತ್ತೋಲೆ ಹೊರಡಿಸಿದೆ.

ಕರ್ನಾಟಕ ಸಾರ್ವಜನಿಕ ಸಂಗ್ರಹಣಾ ಪೋರ್ಟಲ್‌ನಲ್ಲಿ (ಕೆಪಿಪಿಪಿ) 1.0 ಆವೃತ್ತಿಯನ್ನು ಅ.14ರಿಂದ ನಿಷ್ಕ್ರಿಯಗೊಳಿಸಲಾಗಿದೆ. ಹೀಗಾಗಿ, ಅದರಲ್ಲಿ ಬಾಕಿ ಇರುವ ಟೆಂಡರ್‌/ ಹರಾಜುಗಳನ್ನು ಮೂರು ತಿಂಗಳಲ್ಲಿ ಪೂರ್ಣಗೊಳಿಸಬೇಕು. ಇಲ್ಲದಿದ್ದರೆ, ಎಲ್ಲ ಇಎಂಡಿಯನ್ನು ಮುಟ್ಟುಗೋಲು ಹಾಕಿಕೊಂಡು, ಆಯಾ ಇಲಾಖೆಯವರು ಸರ್ಕಾರದ ಸಂಚಿತ ನಿಧಿಗೆ ಜಮೆ ಮಾಡಬೇಕು ಎಂದು ಇ–ಆಡಳಿತದ ಮುಖ್ಯ ಕಾರ್ಯನಿರ್ವಹಣಾಧಿಕಾರಿ ಸೂಚಿಸಿದ್ದಾರೆ.
