Fees fixed as per guideline rates: Government notifies new rules

Bengaluru: The government has notified draft rules to provide premium FAR up to 60% by paying 50% of the guideline rate of the site.
The bill, which was passed in the legislature, to allow the purchase and sale of ‘premium land area ratio’ (premium FAR), was sent to the Governor for approval. After asking many questions, the Governor sent the bill back to the government. Instead of answering them, the government framed new rules and the Urban Development Department issued a notification, giving the public one month to file objections.
It is proposed to amend Section 13-E of the ‘Karnataka Town and Country Plan – 2015’ and the zoning rules of the Revised Master Plan – 2015 have been changed for premium FAR.
Those who have constructed a building and those who are constructing it after the plan has been approved can obtain ‘Premium FAR’ and construct additional floors. The FAR has to be used in that building itself and cannot be transferred to anyone.
The builders of the building can obtain premium FARs from the local planning authority by paying a fee as per the guideline rate. Through this, they can construct additional floors over and above the FAR fixed for the size of the building site. Premium FAR is permitted only as per the zoning rules of the approved master plan of the competent authority granting permission for the construction of buildings.
Buildings with a road width of 9 meters to 12 meters will be given a premium FAR of 20 percent based on the built-up area. Buildings with a road width of 12 meters to 18 meters can get a maximum premium FAR of 40 percent and buildings with a road width of more than 18 meters can get a maximum premium FAR of 60 percent. The rules explain that along with the premium FAR, TDR can also be obtained.
Even if a premium FAR is obtained, only 40 percent more than the approved area of the building can be built. The remaining area can be obtained as TDR, which is also allowed to be sold in the new rules.
Exemption from setback!
‘When a premium FAR is obtained, the height of the building increases. It is the owner’s duty to ensure that the building has the necessary structural design and strength. An exemption will be given from the setback that occurs when an additional floor is constructed after obtaining a premium FAR,’ said city planning officials.
The premium FAR system will not benefit buildings built on an area of 30 feet x 40 feet or 40 feet x 60 feet. 'Premium FAR' will be most useful for apartments built on very large areas.
