Waste Collection and Disposal Halted in Many Parts of the City; Complaints Filed Against 30 Contractors
ESMA Invoked Against Garbage Contractors… ಕಸ ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ‘ಎಸ್ಮಾ’
Bengaluru: Due to a standoff between waste collection and disposal contractors and officials of the Bengaluru Solid Waste Management Limited (BSWML), garbage collection and disposal have been halted in several parts of the city since Monday.
The Assistant General Managers (AGMs) of BSWML have filed complaints at various police stations against more than 30 contractors for failing to manage solid waste properly and violating the Essential Services Maintenance Act (ESMA).
Many waste collection and transportation workers have refused to report to duty, protesting against alleged exploitation. As a result, door-to-door waste collection did not take place in several areas on Monday. With most workers expected to stay away starting Tuesday, the crisis is likely to worsen, and BSWML has yet to implement any alternative arrangements.
The Complaint:
"Contractors appointed for primary collection and transportation of solid waste are required to collect wet and dry waste separately from households and transport it to processing plants or landfills. They are failing to do this effectively. Since waste disposal is categorized as an essential service, it falls under ESMA. On Monday (March 23), contractors showed severe negligence by not collecting waste. This act poses a threat to public health and is a clear violation of the ESMA Act. In the interest of public health and city hygiene, legal action must be taken against these contractors for dereliction of duty," the AGMs stated in their complaints.
Workers Leaving for Home:
Contractors, however, paint a different picture. "Workers are deeply distressed by being forced to pick through waste on the streets. Many have fallen ill. Consequently, they have refused to work and are heading back to their hometowns," contractors said.
They added that approximately 80% of the workforce consists of people from Tamil Nadu and West Bengal. Since assembly elections have been announced in those states, many are traveling home to vote. Those who remain are refusing to handle the waste manually.
Counter-Complaint: "Exploitation of Workers"
S.N. Balasubramaniam, General Secretary of the Contractors' Association, hit back:
"According to the 'Supply Work Order' given to contractors, we are supposed to provide vehicles and workers for door-to-door collection and transportation. However, workers are being forced to manually sort through garbage, which is a form of exploitation. This is why they aren't showing up. We wrote to the GBA Chief Commissioner and the CEO of BSWML on March 17, requesting alternative arrangements in the interest of public health."
He further alleged: "When we request that workers not be subjected to inhumane labor, we are threatened with ESMA. Workers tell us they would rather quit than pick garbage off the streets. The CEO and COO of BSWML have intimidated their subordinates into filing these police complaints. We will also file a complaint regarding the inhumane treatment of workers. Furthermore, they haven't paid our bills for six months, though they are lying and claiming they have."
"Blackmail by Some Contractors"
Karigowda, CEO of BSWML, countered these claims:
"We are working strictly according to solid waste management rules. The contract specifies collecting dry and wet waste separately from homes and handing it over to trucks or processing plants. Instead, they collect mixed waste and sort it on the streets themselves. We never asked them to pick garbage on the streets. Furthermore, it is the contractor's duty to provide safety gear to workers. Some contractors are failing to do their jobs and are instead trying to blackmail us by shifting the blame. We will not be intimidated and will act according to the law."
Regarding the financial dispute, he added: "There is a six-month backlog in payments. We started releasing the amount for three months on Monday evening, and the remaining three months' dues will be paid shortly."

ಬೆಂಗಳೂರು: ತ್ಯಾಜ್ಯ ಸಂಗ್ರಹ ವಿಲೇವಾರಿ ಗುತ್ತಿಗೆದಾರರು ಮತ್ತು ಬೆಂಗಳೂರು ಘನತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆ ನಿಯಮಿತದ (ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್) ಅಧಿಕಾರಿಗಳ ನಡುವಿನ ಪೈಪೋಟಿಯಿಂದ ನಗರದ ಹಲವು ಭಾಗಗಳಲ್ಲಿ ಸೋಮವಾರದಿಂದ ಕಸ ಸಂಗ್ರಹ, ವಿಲೇವಾರಿ ಸ್ಥಗಿತಗೊಂಡಿದೆ.
ಘನತ್ಯಾಜ್ಯ ನಿರ್ವಹಣೆಯನ್ನು ಸಮರ್ಪಕವಾಗಿ ನಿರ್ವಹಿಸದೆ ‘ಎಸ್ಮಾ ಕಾಯ್ದೆ’ ಉಲ್ಲಂಘಿಸಿರುವ ಗುತ್ತಿಗೆದಾರರ ಮೇಲೆ ಕ್ರಮ ಕೈಗೊಳ್ಳುವಂತೆ ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್ನ ಸಹಾಯಕ ಪ್ರಧಾನ ವ್ಯವಸ್ಥಾಪಕರು (ಎಜಿಎಂ) ಆಯಾ ಪೊಲೀಸ್ ಠಾಣೆಗಳಲ್ಲಿ 30ಕ್ಕೂ ಹೆಚ್ಚು ದೂರು ನೀಡಿದ್ದಾರೆ.
ತ್ಯಾಜ್ಯ ಸಂಗ್ರಹ, ಸಾಗಣೆ ಮಾಡುವ ಕಾರ್ಮಿಕರಲ್ಲಿ, ಹಲವರು ತಮ್ಮ ಮೇಲೆ ನಡೆಯುತ್ತಿರುವ ಶೋಷಣೆಯನ್ನು ವಿರೋಧಿಸಿ ಕೆಲಸಕ್ಕೆ ಹಾಜರಾಗಿಲ್ಲ. ಹೀಗಾಗಿ, ನಗರದಲ್ಲಿ ಸೋಮವಾರದಿಂದ ಹಲವು ಪ್ರದೇಶಗಳಲ್ಲಿ ಮನೆಗಳಿಂದ ತ್ಯಾಜ್ಯವನ್ನು ಸಂಗ್ರಹಿಸಿಲ್ಲ.
ಮಂಗಳವಾರದಿಂದ ಬಹುತೇಕ ಎಲ್ಲ ಕಾರ್ಮಿಕರು ಕೆಲಸದಿಂದ ಹೊರಗುಳಿಯುವುದರಿಂದ, ಕಸ ಸಂಗ್ರಹ ಹಾಗೂ ಸಾಗಣೆಯಲ್ಲಿ ಸಾಕಷ್ಟು ಸಮಸ್ಯೆಯಾಗಲಿದೆ ಎನ್ನಲಾಗಿದೆ. ಆದರೆ, ಇದಕ್ಕೆ ಪರ್ಯಾಯ ಕ್ರಮಗಳನ್ನು ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್ ಕೈಗೊಂಡಿಲ್ಲ.
ದೂರು: ‘ಘನತ್ಯಾಜ್ಯದ ಪ್ರಾಥಮಿಕ ಸಂಗ್ರಹ, ಸಾಗಣೆಗೆ ನೇಮಿಸಲಾದ ಗುತ್ತಿಗೆದಾರರು, ಮನೆಗಳಿಂದ ಹಸಿ ಮತ್ತು ಒಣ ಕಸವನ್ನು ಪ್ರತ್ಯೇಕವಾಗಿ ಸಂಗ್ರಹಿಸಿ, ಸಂಸ್ಕರಣಾ ಘಟಕ ಹಾಗೂ ಭೂ ಭರ್ತಿ ಪ್ರದೇಶಗಳಿಗೆ ಸಾಗಿಸಬೇಕು. ಇದನ್ನು ಅವರು ಸಮರ್ಪಕವಾಗಿ ನಿರ್ವಹಿಸುತ್ತಿಲ್ಲ. ಕಸ ವಿಲೇವಾರಿಯನ್ನು ಅತ್ಯಗತ್ಯ ಸೇವೆ ಎಂದು ಪರಿಗಣಿಸಿ ‘ಎಸ್ಮಾ’ ಕಾಯ್ದೆಯಡಿ ತರಲಾಗಿದೆ. ಗುತ್ತಿಗೆದಾರರು ಸೋಮವಾರದಂದು (ಮಾರ್ಚ್ 23), ತ್ಯಾಜ್ಯ ಸಂಗ್ರಹಿಸದೆ ತಮ್ಮ ಕರ್ತವ್ಯದಲ್ಲಿ ತೀವ್ರ ನಿರ್ಲಕ್ಷ್ಯ ತೋರಿರುತ್ತಾರೆ. ಈ ಕೃತ್ಯವು ಸಾರ್ವಜನಿಕ ಆರೋಗ್ಯಕ್ಕೆ ಭಂಗ ತರುವಂತಹದ್ದಾಗಿದ್ದು, ‘ಎಸ್ಮಾ’ ಕಾಯ್ದೆಯ ಸ್ಪಷ್ಟ ಉಲ್ಲಂಘನೆಯಾಗಿರುತ್ತದೆ. ಸಾರ್ವಜನಿಕ ಹಿತದೃಷ್ಟಿಯಿಂದ ಹಾಗೂ ನಗರದ ನೈರ್ಮಲ್ಯವನ್ನು ಕಾಪಾಡುವ ನಿಟ್ಟಿಯಲ್ಲಿ ಕರ್ತವ್ಯಲೋಪ ಎಸಗಿರುವ ಗುತ್ತಿಗೆದಾರರ ವಿರುದ್ಧ ‘ಎಸ್ಮಾ’ ಕಾಯ್ದೆಯನುಸಾರ ಕಾನೂನು ಕ್ರಮ ಜರುಗಿಸಬೇಕು’ ಎಂದು ಎಜಿಎಂಗಳು ದೂರಿನಲ್ಲಿ ತಿಳಿಸಿದ್ದಾರೆ.
ಊರುಗಳಿಗೆ ಹೊರಟ ಕಾರ್ಮಿಕರು: ‘ಮನೆಗಳಿಂದ ಕಸ ಸಂಗ್ರಹ, ಸಾಗಣೆ ಮಾಡುವ ಕಾರ್ಮಿಕರ ರಸ್ತೆಯಲ್ಲಿ ತ್ಯಾಜ್ಯ ಆಯುವುದರಿಂದ ಸಾಕಷ್ಟು ನೊಂದಿದ್ದಾರೆ. ಹಲವು ರೀತಿಯ ರೋಗಗಳೂ ಬಂದಿವೆ. ಹೀಗಾಗಿ, ಅವರು ಕೆಲಸಕ್ಕೆ ಬರುವುದಿಲ್ಲ ಎಂದು ಹೇಳಿದ್ದಾರೆ. ಅವರ ಊರುಗಳತ್ತ ಹೊರಡುತ್ತಿದ್ದಾರೆ’ ಎಂದು ಗುತ್ತಿಗೆದಾರರು ಹೇಳಿದರು.
‘ಕಾರ್ಮಿಕರಲ್ಲಿ ಬಹುತೇಕರು ತಮಿಳುನಾಡು ಹಾಗೂ ಪಶ್ಚಿಮ ಬಂಗಾಳದವರು. ಆ ರಾಜ್ಯಗಳಲ್ಲಿ ವಿಧಾನಸಭೆ ಚುನಾವಣೆ ಘೋಷಣೆಯಾಗಿರುವುದರಿಂದ, ಕಾರ್ಮಿಕರು ತಮ್ಮ ಊರುಗಳತ್ತ ಪ್ರಯಾಣಿಸುತ್ತಿದ್ದಾರೆ. ಹೀಗಾಗಿ, ಕಾರ್ಮಿಕರ ಸಂಖ್ಯೆ ಸುಮಾರು ಶೇ 80ರಷ್ಟು ಕಡಿಮೆಯಾಗಿದೆ. ಉಳಿದವರು ಕಸ ಆಯುವುದಿಲ್ಲ ಎನ್ನುತ್ತಿದ್ದಾರೆ’ ಎಂದು ಗುತ್ತಿಗೆದಾರರು ತಮ್ಮ ಸಮಸ್ಯೆ ಹೇಳಿಕೊಂಡರು.
ಕಾರ್ಮಿಕರಿಗೆ ಶೋಷಣೆ: ಪ್ರತಿ ದೂರು
‘ಗುತ್ತಿಗೆದಾರರಿಗೆ ನೀಡಿರುವ ‘ಸರಬರಾಜು ಕಾರ್ಯಾದೇಶ’ದಂತೆ, ಪ್ರತಿನಿತ್ಯ ಮನೆಗಳಿಂದ ಕಸವನ್ನು ಪ್ರಥಮ ಹಂತದ ಸಂಗ್ರಹ, ದ್ವಿತೀಯ ಹಂತದ ಸಾಗಣೆಗೆ ವಾಹನಗಳು, ಕಾರ್ಮಿಕರು ಒದಗಿಸಬೇಕು. ಆದರೆ, ಕಾರ್ಮಿಕರಿಂದ ಕಸವನ್ನು ಆಯಿಸಲಾಗುತ್ತಿದೆ. ಈ ಮೂಲಕ ಅವರನ್ನು ಶೋಷಿಸಲಾಗುತ್ತಿದೆ. ಇದರಿಂದ ಅವರು ಕೆಲಸಕ್ಕೆ ಬರುತ್ತಿಲ್ಲ. ಈ ಬಗ್ಗೆ ಸಂಘದ ವತಿಯಿಂದ ಜಿಬಿಎ ಮುಖ್ಯ ಆಯುಕ್ತರು, ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್ನ ಸಿಇಒ ಅವರಿಗೆ ಮಾರ್ಚ್ 17ರಂದೇ ಪತ್ರ ಬರೆದು ತಿಳಿಸಿದ್ದೆವು. ಸಾರ್ವಜನಿಕರ ಆರೋಗ್ಯದ ದೃಷ್ಟಿಯಿಂದ ಪರ್ಯಾಯ ವ್ಯವಸ್ಥೆ ಮಾಡಿಕೊಳ್ಳಲೂ ಮನವಿ ಮಾಡಿಕೊಂಡಿದ್ದೆವು’ ಎಂದು ಸಂಘದ ಪ್ರಧಾನ ವ್ಯವಸ್ಥಾಪಕ ಎಸ್.ಎನ್. ಬಾಲಸುಬ್ರಮಣಿಯಂ ತಿಳಿಸಿದರು.
‘ಕಾರ್ಮಿಕರಿಂದ ಅಮಾನವೀಯ ಕೆಲಸ ಮಾಡಿಸಬೇಡಿ ಎಂದು ಮನವಿ ಮಾಡಿಕೊಂಡರೆ, ಎಸ್ಮಾ ಜಾರಿ ಮಾಡುತ್ತೇವೆ ಎಂದು ನಮ್ಮನ್ನು ಬೆದರಿಸಲಾಗುತ್ತಿದೆ. ರಸ್ತೆಯಲ್ಲಿ ಕಸವನ್ನು ನಾವು ಆಯುವುದಿಲ್ಲ ಎಂದು ಕಾರ್ಮಿಕರು ನಮ್ಮಲ್ಲಿ ಹೇಳುತ್ತಿದ್ದಾರೆ. ನಮಗೆ ಕೆಲಸ ಬೇಡವೇ ಬೇಡ ಎನ್ನುತ್ತಿದ್ದಾರೆ. ಬಿಎಸ್ಡಬ್ಲ್ಯು
‘ಕೆಲವು ಗುತ್ತಿಗೆದಾರರಿಂದ ಬ್ಲ್ಯಾಕ್ಮೇಲ್’
‘ಘನತ್ಯಾಜ್ಯ ವಿಲೇವಾರಿ ನಿಯಮದಂತೆಯೇ ನಾವು ಕೆಲಸ ನಿರ್ವಹಿಸುತ್ತಿದ್ದೇವೆ. ಮನೆಯಿಂದ ಒಣ ಹಾಗೂ ಹಸಿ ಕಸವನ್ನು ಪ್ರತ್ಯೇಕವಾಗಿ ಸಂಗ್ರಹಿಸಿ, ಅದನ್ನು ಲಾರಿ ಅಥವಾ ಸಂಸ್ಕರಣೆ ಘಟಕಗಳಿಗೆ ನೀಡುವಂತೆ ಗುತ್ತಿಗೆ ನೀಡಲಾಗಿದೆ. ಆದರೆ, ಮಿಶ್ರ ಕಸವನ್ನು ಸಂಗ್ರಹಿಸಿ ಅವರೇ ರಸ್ತೆಯಲ್ಲಿ ಪ್ರತ್ಯೇಕಿಸುತ್ತಿದ್ದಾರೆ. ನಾವು, ರಸ್ತೆಯಲ್ಲಿ ಕಸ ಆಯುವಂತೆ ಹೇಳಿಲ್ಲ. ಅಲ್ಲದೆ ಕಾರ್ಮಿಕರಿಗೆ ಅಗತ್ಯ ರಕ್ಷಕ ಸಾಮಗ್ರಿಗಳನ್ನು ನೀಡುವುದು ಗುತ್ತಿಗೆದಾರರ ಕರ್ತವ್ಯ. ಕೆಲವು ಗುತ್ತಿಗೆದಾರರು ತಮ್ಮ ಕೆಲಸವನ್ನು ತಾವು ಮಾಡದೆ ಸುಮ್ಮನೆ ನಮ್ಮ ಮೇಲೆ ಗೂಬೆ ಕೂರಿಸಿ, ಬ್ಲ್ಯಾಕ್ಮೇಲ್ ಮಾಡುತ್ತಿದ್ದಾರೆ. ಇದಕ್ಕೆಲ್ಲ ನಾವು ಹೆದರುವುದಿಲ್ಲ. ಕಾನೂನು ಪ್ರಕಾರವೇ ಕ್ರಮ ಕೈಗೊಳ್ಳುತ್ತೇವೆ’ ಎಂದು ಬಿಎಸ್ಡಬ್ಲ್ಯುಎಂಎಲ್ನ ಸಿಇಒ ಕರೀಗೌಡ ಹೇಳಿದರು.
‘ಆರು ತಿಂಗಳ ಬಿಲ್ ಪಾವತಿ ಬಾಕಿ ಇದೆ. ಮೂರು ತಿಂಗಳ ಬಿಲ್ ಮೊತ್ತವನ್ನು ಸೋಮವಾರ ಸಂಜೆಯಿಂದ ಬಿಡುಗಡೆ ಮಾಡಲು ಆರಂಭಿಸಿದ್ದೇವೆ. ಉಳಿದ ಮೂರು ತಿಂಗಳ ಮೊತ್ತವನ್ನೂ ಕೂಡಲೇ ಪಾವತಿಸಲಾಗುತ್ತದೆ’ ಎಂದು ಹೇಳಿದರು.
